Not to freak anybody out, but I think that a government agency only needs a subpoena if facebook doesn't want to turn over its records. If I read the Terms of Service correctly, facebook is free to use, pass on or sell anything that's posted there.
What I see reads, in part (copyright facebook, of course), "...you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Facebook ("IP License")."
I Am Not A Lawyer, and if you construe anything I ever write as legal advice, you'll probably end up broke and shoveling mud in a Shanghai leper colony. So check it out independently.
I'm not telling anyone not to use facebook. I'm reflecting on the notion that, if you post something on the Net, you're putting it out into the world, and it's out of your hands.
