D-Day in front of the judge in Union Co NJ 12/18

Wow. I've been keeping up with your other thread. I hate to hear that's STILL going on.

You would think with something this old they would just put it in front of the judge like they did with the expungement but this judge wants to see me face to face. My lawyer also said he's got 4 or 5 other clients from Florida with 10 or more year old court orders that have come back to haunt them and they all have passed FDLE checks too. He thinks NJ either updated a database or started record sharing or something. Alot of people like me also thought that like all other states a NJ restraining order would expire but according to him it's lifetime unless you petition the courts and since NJ hands out more than any other state it's their way of pushing their gun control agenda from coast to coast.

As an aside, if things don;t go too well, there is another possible tack to take in about 6 months time.

The McDonald v Chicago case, assuming it goes as expected, (2A incorporated, via 14th Amendment P+I and Heightened Intermediate Scrutiny) will be a possible affirmative defense for the Lautenberg Amendment being either wholly or partially unconstitutional.

So, if this current action goes pear shaped, have your lawyer file an appeal or stay pending McDonald, there is is already some case law on this in the 7th Circuits Skoien case.

"Protection Orders" are what one lawyer called the SOP of any divorce lawyer's bag-O-tricks. A divorce lawyer (especially for women) tells them to call in ANYTING to the police so it will look bad on his record when it comes time to split. They'll say to file for a protection order even if you have to "enhance" the circumstances. The mate doesn't realize (or care) that it might put a permanent really bad mark on the other's record.

I don't know what caused your ex to file - nor do I want to - but friends of mine have paid dearly during a divorce to battle these protection orders.

Obviously, some are very real and some are sorta warranted but it's the rest that make the whole process stink.

Yup. One spouse claims violence, the other is out but still has to pay the mortgage. If the claimant's attorney is smart they will also make sure the claimant is allowed to control the sale of the house and Voila! Free house!

Don't EVER let anything get on your record without fighting it, criminal complaints, restraining orders, traffic tickets and anything else can come back to haunt you.
 
Victory at last. My lawyer had met the judge at a BAR Association event the night before,the plaintiff never showed up and that went in my favor. This morning my lawyer went in for an hour long meeting first and looked worried when he came out, he told me the judge was worried that no original tapes or transcripts could be located so he had 4 different property clerks testify that all records up to 1999 had been destroyed. The biggest thing that went in my favor though was my honesty about the original charge,tha fact that I was dressed in a suit ant tie(all these other disrespectful jerkoffs were walking into the courtroom with ripped pants hanging down,underwear showing,raggy jackets and no haircuts) When the judge asked if I had anything to say I told him that when I left NJ I lost my house and was 60,000 in debt now I live on the water in florida and am debt free with my wife and I have a 3yr old grandaughter not worth giving up for anyone. That's really great. Hate that you had to jump through so many hoops over some goofy state's hand wringing, but so glad it worked out.
