Boy Harassed By Police, Family Says

LOUISVILLE, Ky. -- The family of a teenager who was shot and killed after he stabbed a police officer said the police didn't need to end the boy's life.

Brandon Erdman, 15, had been in trouble with the law before prior to Monday, when he stabbed New Albany Officer Laura Schook with an 8-inch knife during a scuffle, WLKY NewsChannel 32 reported.

The confrontation took place at about 9 p.m. Monday in an alley between Oak and Elm streets after a short chase. The chase came after a report of a knife-wielding suspect who tried to break a window at the Swifty gas station and convenience store three blocks away at Spring and Silver streets.

According to NewsChannel 32, Schook shot Erdman at least once, but after the first shot, the suspect remained standing and approached Pumphrey, who'd just arrived at the scene. Pumphrey also shot Erdman, who fell to the ground and was pronounced dead a short time later, police said.

Schook underwent surgery after she was stabbed Monday night, and is expected to make a full recovery.

Schook reportedly fired at least two shots and Pumphrey fired at least three shots, according to investigators, but it's not clear how many of the shots struck Erdman.

Schook suffered neck and facial injuries from the knife attack. She is expected to make a full recovery.

Police said Erdman acted disturbed and overly aggressive to the point that the officers had no choice but to shoot.

Mother Says Boy Was Intoxicated

Mindy Hardin, the mother of Brandon Erdman, told NewsChannel 32 Tuesday that a homeless man bought her son a fifth of 190-proof liquor just prior to his death.

"My son's toxicology report is four times the legal amount," she said.

Hardin said also that police were looking for her son in the hours prior to the gas station incident because he kicked out the windshield in her car.

"They had a description of Brandon from head to toe," she said. "I told the officer right out there in front of this house, thirty minutes before he was shot and killed. I couldn't get to the end of that alley fast enough. I just couldn't get there to pick him up."

According to Erdman's aunt, Elizabeth Hardin, the teen was supposed to be leaving town soon.

"He was actually on his way to Florida to live with his dad," Elizabeth Hardin said. "He was 600 yards from being in Florida."

Erdman feared the police, his aunt said, following a four-day stay in juvenile detention because of a marijuana charge.

"The cops come to school, pull him out of class, take him and interrogate him for two hours, no adult, no parent, no teacher, no principal, no nothing, and then send him back to class after they do that and expect him to have a normal day," Elizabeth Hardin said.

Erdman's family claimed also that the shooting wouldn't have happened if the teen had not been harassed by the police. They are planning to contact the Indiana Civil Liberties Union to see if they can take legal action, Charlton reported.

Erdman's family acknowledged that the boy's problems were no excuse to attack a police officer with a knife, but they don't think the officers needed to shoot until the boy was dead.

"The only thing I can't understand is why they had to shoot him more than once," Mindy Erdman said. "He was already injured, and yes, he got back up, but they have other things."

New Albany Police Chief David Graves said officers are trained to use deadly force to defend themselves.

"On each shift, we have the pepperball weapons, but of course, that's not something you can use on a split second basis," Graves said.

Schook joined the force in 1995, while Pumphrey just joined last year. Monday's incident was the first time the officers fired their guns.

Graves described each officer as responsible, dependable and level-headed. They've been placed on paid administrative leave pending the outcome of the investigation, which is being handled by the Indiana State police.

Erdman's funeral arrangements are pending.

More of the same... "Good boy" stuff...

""My son's toxicology report is four times the legal amount," she said. "

And that obviates the fact that he was slinging an 8" knife around how, and had already stabbed one person, how?

Seems to me the kid had a lot of choices that he could have made differently...

Don't get alcohol from a homeless guy.

Don't drink the alcohol.

Don't kick your mom's windscreen out of her car.

Don't carry a knife with you when you flee.

Don't stab an officer of the law.

One less thug on the streets. NO sympathy for the family here. Little punk deserved everything he got.

Yeah, that woman's an idiot. She's trying to play on the bad rep police have gotten in this area in the past few years, & the local news stations really try to play it up.
As I was getting ready for work yesterday morning, I watched this woman complain that the police, one of whom had been stabbed in the neck and was at the time in the hospital in critical condition, should have used nonlethal force. If anything, the mother should be charged for allowing her teenage son to get that drunk. It's a real shame that these people are trying to cash in on the death of their attempted-murderer relative.

I'm pretty skeptical of Law Enforcement by nature, but if a punk stabs you, you shoot him, and he gets up, you're supposed to use a less lethal form of force?

I think not.

Sounds to me like Mindy's gunnin' for a bucketful of taxpayer dough. She won't get it.

Among the cleanest shootings I've ever read about.

I'm sorry she lost her son. I'm sorry the officers had to do what they had to do. But on with my question...

"Don't get alcohol from a homeless guy."

I want to know HOW you get alcohol, or money for alcohol, from a homeless guy. The ones around here have never been known to give a sip of it away - much less a whole bottle of high test stuff. Something doesn't ring true.

Agreed. I'm not exactly gung-ho about the state of modern law enforcement, but I'll be darned if I'll second guess a law enforcement officer's decision to use deadly force after one of them was stabbed.

"Shoulda pepper sprayed him" doesn't cut it, ma'am, no matter how tragic your loss.....

You send him in for the alkyhall, giving him enough money to get what you want, and tell him if he brings it to you you'll give him enough money to buy two of whatever his favorite is...

Seen it done.

Sounds like the officer had little choice. Sorry for the kid but I'm a little tired of hearing parents like mom here who thinks their young, trouble kid with the wrap sheet needs a break when he's trying to stab an officer.

Next step...she'll be looking to sue the officer and the department. No mother of the year award there.

That would mean that this kid was drinking Everclear which is as close to pure grain alcohol as you can buy in a bottle. http://www.beerliquors.com/liquors/grain.htm

Bacardi Rum is 150 proof.

Two proof equals one percent ie/: 100 proof equals 50% alcohol.
"My son's toxicology report is four times the legal amount," she said.
Then your little boy was likely already a walking dead man; that pesky alcohol poisoning thing, ya know.

All you guys need to knock it off. This poor 15 year-old, pot-smoking, drunk child that was roaming the streets at 9 p.m., on a school night, after kicking out his mother’s windshield, attempted to break into a gas station, who stabbed an officer responding to a call, is just a misunderstood soul that could have been brought down by a properly loaded Super-Soaker.

Shame on everyone here for their vicious comments!

Feeling cynical tonight...

Maybe she's right.

Maybe the Police could have just let a teen-aged drunken problem walk around committing random acts of violence until he passed out.

Or used a bullwhip on him. Cops need to carry bullwhips since its a less than lethal weapon and they don't have to get as close in as they would to use pepper spray or their PR-24/ASP.

Lash LaRue, Less than Lethal Local Law Enforcement.

Maybe.

Could be I'm not really feeling too sorry for Mrs Erdman, er Mindy Hardin, whatever, or as sorry as I should here.

Gonna send him to Daddy in FLA and let him deal with him for a bit?
600 yds from Florida and a million miles from riding with the law, not agin it.

I hope Officer Shook recovers soon and learns not to scuffle with idiots with 8" blades.

Can you imagine being a Cop today? A lot of people here bash them, but they're all hero's in my book; till I meet the wrong one and then it'll be that one and only that one that I'd ever say or think bad things about. Talk about darned if ya do darned if ya don't...

But, maybe she's right. Maybe they should have left him alone to hurt or kill someone else in the neighborhood, maybe they shouldn't care. One less future problem to deal with. Let the FLA LEO deal with him.

I hope FLA police send Ms Shook get well and thank you cards (Pumphrey too) for the next week or so.

Told ya I was feeling cynical. I know its not high road... sorry all.

Adios

"...tell him if he brings it to you you'll give him enough money to buy two..."

Oh, you live in an intellectual neighborhood. :)

I'm talking about the ones who can't remember their name half the time. You know, the Sterno strainers.

sorry...Darwin at it's finest

Anyone who gets drunk and then assualts a armed person-be it officer or law abiding citizen-with a deadly weapon-a 8" knife is asking for death.

PERIOD

sorry...the chain of events that punk went though was his own fault, and the officers did what was needed to stop a potentially fatal attack-no overkill here

NO sympathy

I hear the rattlings of a person who seeking to soak the system for money

I was told this one story from chester PD. A while back an veterin officer and his rookie (who happen to be white) went into foot pursuit of a 15 year old black male who hit a stop and rob. They chased him into an ally which was a dead end, when the perp got to the end he spun around and raised a handgun and fired a wild shot. The veterin offecer drew his gun and did 3 shots from about 15-20 yards. And he reholstered his weapon and proceeded to casually walk over to the body. The rookie asked "what are you doing?" he said "trust me". They walked up, the kid had 2 in his chest and one in his forehead.

When it was dismissed from court the officer was asked "Why?" by the sobbing victims mother infront of the media on the steps of the courthouse, to which he responded "Because i'm a better shot than your son."

Then came the riots...

let me see,,,, mommy called the cops for help??

Hardin said also that police were looking for her son in the hours prior to the gas station incident because he kicked out the windshield in her car.

"They had a description of Brandon from head to toe," she said. "I told the officer right out there in front of this house, thirty minutes before he was shot and killed. I couldn't get to the end of that alley fast enough. I just couldn't get there to pick him up."

And he knifed one of the cops? And she thinks they should not have been there? Or she thinks they should have let him kill them? Maybe instead of dialling 911 she should have run to the nearest store and bought her own pepper spray?

Sorry, not to join this discussion sooner, I've been away for a few days.

I feel slightly more qualified than most to comment on this topic. After all, it occurred in the alley a block from my front door. Had I not called it an early night and decided not to stop for gas, I would have been right in the middle of the crime scene.

The mother and aunt were playinig the "he didn't deserve to be shot" angle from the very first interview. Mother says "Why didn't they shoot him in the leg if they wanted to stop him from moving" aunt chimes in "They don't WANT to do that, when cops draw their guns they shoot to kill".

The kid in question has had a troubled past as has already been mentioned here. He was constantly shuttled back and forth between here and his father in Florida. From interviews and statements given, when one could no longer control him, or he was in sufficient trouble that he needed to leave town, they would ship him off to the other parent. He was in fact due to leave town that night. He busted out his mother's windsheild in a drunken rage, because she wouldn't get him out of town sooner.

The officer was released from the hospital a few days ago and will recover. The trauma surgeon said she is very lucky, the knife struck between her vest and collarbone in the upper chest. If it had penetrated at even a slightly different angle, or any deeper it would have pierced the jugular vein.

I have sympathy for the family, for their loss. Even a bad kid is loved by his family. However, I have no sympathy for the victim. He chose his path, and his utlimate demise.

good shoot

even as drunk as I got at 15 I never would have
vandalized my mom's car,dad would have
beat the crap outta me for that.
Fact is they raised that kid to be a moron who
gets drunk and stabbs a police officer raising
the amount of force needed to stop the threat.
I got drunk and rowdy as a kid and carried big knives too,
but I never would have raised one at a police officer, not
over fear of getting shot but fear of getting the knife confiscated.

...and so the world is just a little safer at night.

*sigh* I love a happy ending. :D

Shooting a kid for assaulting an officer = clean shoot

Also, if anyone was going to, let's please not blame the parents.

I get sick and tired of hearing that parents are responsible for their kids' wrongdoing. People have free will. You teach about right and wrong, and sooner or later someone's going to decide that wrong is more fun.

Not that she's a prize parent
