A county attorney general in Wisconsin has decided to stop prosecuting violations of some WI state statutes.

"Though declaring 5 Wisconsin statutes unconstitutional, Fox cautioned Wisconsin gun owners to be careful until the Wisconsin legislature repeals these statutes - however, he added with emphasis, "in Jackson County, they don't risk prosecution" for violating these 5 statutes."

Wisconsin Army National Guard JAG officer, and Jackson County District Attorney, Gerald R. Fox has something to say about the US Supreme Court's decision in McDonald v. Chicago released earlier this week and holding that the Second Amendment's protections apply against state regulation. In a press release Fox declared 5 Wisconsin state statute unconstitutional:

"I hereby declare that this office will no longer accept law enforcement referrals for violations of the following statutes:

Section 167.31, prohibiting uncased or loaded firearms in vehicles;

Section 941.23, prohibiting the carrying of concealed weapons, including firearms;

Section 941.235, prohibiting the possession of firearms in public buildings;

Section 941.237, prohibiting the possession of firearms in establishments where alcohol may be sold or served; and,

Section 941.24, prohibiting the possession of knives that open with a button, or by gravity, or thrust, or movement."

District Attorney Fox told the examiner.com that the US Supreme Court was clear - the right to bear arms is "fundamental," and therefore state governments can only restrict these rights by way of regulations which are "narrowly tailored to achieve a compelling state interest." Fox said that the Wisconsin Supreme Court decisions in the past on right to bear arms were "intellectually dishonest just like the McDonald minority opinion" because these rulings placed the burden on the citizen to assert a compelling individual need to bear arms to counter the state's interest in enacting general prohibitions on carrying arms.

I hope you (and the County Attorney General) are right, but there are a considerable number of leftist liberals in Wisconson that will fight this tooth and nail, claiming that "reasonable regulation" of arms outside one's residence is O.K. This is going to be a long fight that is just beginning.

This is not to say you won't win though. Because the "right to keep and bear arms," is now a recognized civil right, gun control advocates will face a real uphill battle.
 
I wish our AG had balls like that. We are finally fighting on the other side of the field. Its still a fight but at least we are now on offense. We should all put pressure on our local and state prosecutors to follow suit in each State.
 
You guys may have missed this, but Mr Fox is a Democrat. Please keep the "liberal" bashing out of this, it only serves to divide us.

I made a point of leaving the word "Democrat" out of my post. Mr. Fox may indeed be one, but not necessarily a leftist/liberal one - at least on firearms issues.

This does not change the fact that leftist/liberals - mostly in the larger urban areas - Democrat or not, will strongly oppose any attempt by the Wisconsin legislature to change or repeal the present laws on the basis that they represent "reasonable regulation." I see this as a fact of life that can't be, and shouldn't be ignored.
 
Basically today the RKBA movement is where the Gun Control movement was in 1968.

Lets see what we can do with this advantage we've got ... just remember how things can change (in 68 most folk would tell you that the way things were going, by the late 70s handguns would be NFA items if not outright banned).

Long after this old fart is dead and buried Americans will once again have the inalienable right to KEEP and BEAR arms as they choose. It'll be a long and hard fought battle but the SCOTUS has spoken and we WILL win eventually.

That is rather night and day.

From one of the more restricted places to one of the least restricted places if that press release is at all accurate.

No prosecutions for carrying concealed weapons, firearms or otherwise.
No prosecutions for carrying loaded or in a vehicle.
No prosecutions for carrying in places that serve alcohol.

And no prosecutions for "switchblades".


That on the surface would appear to give equal or greater than Vermont/Alaska/Arizona style carry.
Of course it is still illegal, they just are saying they will not prosecute for it.

Huh? This guy just declared that Americans have the right to such arms, and that he will no longer prosecute people for any of the above because he feels it is contrary to the decision given by the Supreme Court.
He basically just told everyone in his county they will not be prosecuted for walking around with loaded concealed firearms without a permit.

As a county District Attorney, his decision would not seem to have any standing statewide. That could cause some confusion and possibly arrests in other counties.
 
I tend to believe he is making a point to tick off the anti's, including the Pres..for a backlash to the decision, I hope he fails; if that is his goal, and I hope violent crime rate decreases, as it has in all states that lax their concealed carry and open carry laws.

I have this funny feeling that anti's in the national media will report "firearm crime" over the next few months.

I don't have a problem with liberal bashing. Not all Democrats are liberals.

I have a problem with bashing people over a stance I think I agree with though.
 
Nothing wrong with being a Democrat at the statewide level.

What the Democrats do in Wisconson don't matter to me and it is a political question. .

But the Liberals in Washington DC seek to take my Liberty by stacking the Supreme Court.

That stinks.

The best way to protect the RTKBA is to win elections with national implications
 
Make gun rights a civil rights issue

Many who support the ACLU are fond of saying "I do not agree with your position but I will defend to the death your right to say it.". Those who mean it are patriots.

How can we make gun rights equally important:

Seems to me that we need some real education in the universities and law schools.

Maybe some billboards that say:

"I despise your gun but will defend to the death your right to keep and bear one"

Absolutely not! I don't believe for one minute that the forces who want to ban guns will stop no matter how many Supreme Court rulings come out against it.
