Greetings, I am the Chair of the Public Safety Committee of my local Community Board in Manhattan, NYC. As such I will be holding a Public Hearing in September 2012 on self defense and NYS Senate Bill S1427:

PURPOSE: This proposed constitutional amendment would provide within the New York State Constitution for a right of the people to keep and bear arms for traditionally recognized purposes

RIGHT TO KEEP AND BEAR ARMS

SECTION 1. THE PEOPLE SHALL HAVE THE RIGHT TO KEEP AND BEAR ARMS FOR THE DEFENSE OF THEMSELVES AND THE STATE, FOR LAWFUL HUNTING AND RECREATIONAL USE, AND FOR ANY OTHER LAWFUL PURPOSES, AND NO COUNTY, MUNICIPALITY OR OTHER POLITICAL SUBDIVISION OF THE STATE SHALL REGULATE, IN ANY WAY, AN INCIDENT OF THE RIGHT TO KEEP AND BEAR ARMS.

I have not yet set a date and location as I am waiting to see which of our large meeting spaces will be available. If you live in or near NYC feel free to take a look at the information that I will be presenting. I will update all concerned when I lock in a date and time.

Sadly I only see this type of thing going into effect via courtroom victories, not legislation. You're asking New York politicians and police agencies to give up their constantly abused power of preemption. Even though NY law says that they have to issue a handgun license within 6 months, Nassau county now has lead times approaching 2 years. I'm not going to hold my breath for a legislating body that almost passes micro stamping bills every year.
 
As much as I'd like to see this come to pass, I don't think I have enough years left to me for it to happen. The legislature is not likely to pass anything of this nature,

First of all, let me say that I'm glad to see an active participant in our legislative process on here, particularly in light of the fact that you work in one of the more restrictive jurisdictions.

That said, I have a caveat and a comment to make, even though I neither live nor work in your jurisdiction. Caveat: I am a lawyer, but I'm not your lawyer, nor am I licensed in your jurisdiction. What follows is my commentary, not legal advice. If you want legal advice in your jurisdiction, go buy some.

You've spelled out exactly what reasons constitute "acceptable" reasons for keeping and bearing arms, and, by doing so, have opened the door to restricting the RKBA at a state level. It wouldn't take too much imagination to begin chipping away at the shooting sports, for example, which would remove them from the "other lawful purposes." I don't have too much trouble imagining some anti-gun legislator trying to outlaw IDPA, or other similar programs. Also, is a citizen's RKBA limited to "defense of themselves and the state?" IOW, is a citizens RKBA contingent on defense of the State? Perhaps it sounds silly, but there are other possible formulatinos which could lead to very different results when all of the litigation shakes out:
  • "for the defense of themselves, and the defense of the state,"
  • "for the defense of themselves, or the defense of the state,"
  • "for the defense of themselves and the state."

I lived in Manhatten NYC for 12 years. It is a police state and lawful citizens are prevented by state and local governments from excercising their 2nd amendment rights. Criminals in NYC, however, have easy access to all the guns they want.

Unfortunately, this will not change in my lifetime.
 
I don't live anywhere near NY (thankfully--and don't flame please, just my opinion) but I agree, it's good to see anyone trying to change the local laws to attempt to assure our 2A rights. And while I agree the successful passage of this bill has little chance of making it in NYC, best wishes and thank you to mrreynolds for doing what he can.

Hey, if it becomes too onerous in NY, try moving to New Mexico. Much more gun friendly our here and the air's nicer too.
 
I applaud the effort. As someone who was born there decades ago, I agree the fight will be uphill in a vertical manner, but I also agree that you overturning the Sullivan Act, in force for over 100 years, is not going to happen - not with the current NYC administration, nor the current mood in Albany

That being said, SOMEONE has to take the first step and throw the first rock, if you will.

Question: Will the OP's "Community Board Meeting" have any effect on the bill currently in the NY legislative bodies?
Or is the OP trying to gather support for the bill in Manhattan?

Other than a topic for discussion, I fail to see how the OP could have an effect on the bill.

Good luck, one step at a time and stay calm and cool and point out the idiocy they believe in and hope they make fools of themselves. Be mellow like John Denver or Mister Rogers when they spoke to the Senate.
 
I would like to thank everyone for their words of encouragement. Obviously I'm waking a sleeping giant here but my thoughts are as such. I always hear the elected officials state what the people do and do not want, let the people speak.

I will keep it respectful and polite but I want to hear them say "You can't have it because I said so". Two states already determined that the firearms laws violated the 2A. Maryland being the first not sure which was the other.

My only complaint is that these NYC individuals are too soft meaning all they do is complain that they can't get their way but they do nothing they don't formalize anything. While the Anti's get up and speak the hardcore firearms lovers just say hey I won't write a letter or send an email I'll just complain to other complainers. It's a government administration you have a say in government SO START SAYING SOMETHING. It's the Matrix Red or Blue pill pick one. They do it because SOME OF YOU let them.

We never get anything done because we don't do anything you can lobby just like the anti's do. Stop complaining about the NRA not fighting the fight for you. I'm African American from Harlem, NYC I have a NYPD Premise License & Rifle & Shotgun Permit plus several out of state carry licenses. I'm also a licensed FFL01. If I can be the rare anomaly that I am you can assist as well. On top of that I still Chair a Community Board Committee as an unpaid Officer of New York I am the local government I don't let them tell me what I think I tell them.

If possible, have someone record this public hearing on video (use a camera on a tripod, not a cell phone, they are not stable) and put the hearing on youtube or vimeo. Could be useful to show you working to improve your community, if you run for office someday!
