ATF cease and desist order

hey guys, this is my very first post. i have a very serious question, and it needs a very serious answer. i have recently been served a cease and desist order because i was LEGALLY buying up weapons from sites and reselling them for profit on the streets. i did require bill of sales for all my purchases (in AZ no registration is required).anyway, i am still legally able to purchase weapons,,the order said specifically that i am to cease selling weapons without an FFL. well, my question is this: --am i allowed to TRADE my weapons without repercussion?

See the text in bold? You weren't "legally" doing anything.....you were engaging in the business of dealing in firearms without a Federal Firearms License.....which is a violation of Federal law.

You are lucky that you received a cease and desist letter and not an indictment.

As far as trading vs selling? It's the same in the eyes of ATF....you would be engaging in the business without an FFL.

You need to lawyer up now.
 
i was buying from auction sites and reselling them on backpage.com. the agent let it slip that they monitor backpage deals.
 
The old boy out in Weatherford, Tx. is in jail right now for just doing the same thing. Believe he bought and sold 96 in one year.
 
Under the terms of the 1968 GCA an unlicensed person is allowed to buy and sell firearms in a personal collection, but not to buy guns for the express perpose of reselling them! In particular, you can't take orders, and then go out and buy guns to fill those orders, or not hold what you buy for a reasonable time - and the BATF&E gets to define what "reasonable time" is.

If you don't have an FFL, and were actively buying guns and then turning around and selling them you're lucky they didn't take you away in handcuffs. :uhoh:
 
At this point there is nothing to be done on THR that will prevent the OP from putting himself or herself at risk.
