Firearms Industry Files Suit Alleging Process Used to Pass Gun Regulations Violated Connecticut Statutes and Constitution

NEWTOWN, Conn. -- The National Shooting Sports Foundation® (NSSF®), the trade association for the firearms and ammunition industry, today filed suit in federal court for the District of Connecticut alleging that Governor Dannel Malloy and the leadership of the Connecticut General Assembly misused the so-called "emergency certification" exception to circumvent the safeguards of the normal legislative process and in violation of Connecticut statutory law in order to pass Senate Bill 1160, a package of strict gun control regulations.

The suit further alleges that enactment of the new law violates fundamental due process rights guaranteed by both the Connecticut and United States Constitutions. NSSF is asking the court to declare the law invalid and issue an injunction prohibiting its enforcement.

"A 139-page bill was assembled behind closed doors, bypassing both the public hearing and committee processes, and quickly sent to floor votes on the same day in both the House and Senate where legislators did not have adequate time to even read the bill. The governor then signed the package into law the next day. All of this is in violation of guarantees citizens are supposed to have under Connecticut State Statutes and protections in our State and U.S. Constitutions for which our forefathers fought," said Lawrence G. Keane, senior vice president and general counsel, NSSF. "Our suit focuses on this abuse of process that has resulted in enacted law that does nothing to improve public safety, while resulting in adverse effects on law-abiding citizens, manufacturers, retailers and sportsmen's organizations."

The way this thing was passed raises more than a few legal issues. The third link (above) is to a Connecticut Law Tribune editorial that is definitely worth a read, especially by CT residents on the forum.
 
I wish I could afford to donate to the NSSF. This is encouraging, though I am skeptical that it will go anywhere while Malloy, Murphy, and Blumenthal are still in office.

AFAIK, the NSSF doesn't take donations as they are supported by industry and individual membership.

Try SAF, NRA, CCRKBA... but only when you can afford it. I had to sell my organs today to pay for a tank of gasoline...

I am a member and the more active they are, the happier I am. For years, it seemed like their major mission was the SHOT Show but that's changed over the past couple of years. They have a lot of educational material on their website and available as newsletters.

It would be nice if the NSSF took on Andrew Cuomo and the gang of criminals in the New York legislature. They essentially did the same thing when passing the 'SAFE' Act.

Frank, what do you see as a likely timeline for this action? Do you in your experience see this going our way?
 
As someone who lived thru it and are affected by it, the way they snuck around seemed illegal. Hopefully the end result will be a reversal and make them do this the proper way. Thanks for the links!
 
Follow The Leader?

In the case of Connecticut's new gun laws, the experience of New York is definitely the model. The New York SAFE act was created, pushed through the legislature, and became law in exactly the same fashion. The immediate proximity of the two States, and their shared contact with New York City makes me wonder how much of Bloomberg's money was promised to whom as a reward for ignoring due process and following the "Chicago Agenda" in both of these usurpations of due process and representative democracy.

In the case of the NY SAFE Act, the haste was so great that gross errors are present. The original bill made no exceptions for retired LEO's. It set a magazine capacity limit of 7 rounds in spite of there being no such magazine capacity for rifles, and which is seemingly senseless considering that NY State already had a 10 round magazine limit. -Bad research by people who had no familiarity with firearms. I could go on, but these two things illustrate the point well.
