Heads up Jackson MS people and anyone that goes into or lives nearby.

Jackson town council is pushing a bill that would ban guns and knives from (with the exception of law enforcement of course): municipal property, including, but not limited to, City Hall, the Jackson Police Department, the Jackson Police Academy, all public parks, playgrounds, gyms, recreational facilities and fields the city maintains, all meeting places where public meetings of a county, municipality or other governmental body takes place, all political rallies, all parades, all official political meetings and all non-firearm related school, college or professional athletic events.

Doesn't all of this violate Mississippi State Law and the Mississippi Constitution?

Does the state law and the constitution allow a local ordinance to supersede it?

I highly doubt a local ordinance can do that.

Is MS a preemption state? Seattle WA tried this type of thing a number of times and keeps getting smacked down by state preemption.
 
the way I read state law it allows local governing bodies to prohibit carry in city and county parks and meeting places if the jurisdiction wants to. crazy! why have preemption at all?
 
Is the state law old before preemption was passed? That would make it void wouldn't it? We have a lot of laws here in Wi still on the books but are not enforceable anymore since we got preemption back in 98 I think.
 
All parents who love their children should be preparing to move to Jackson. Such a place is bound to be totally free of crime.

But seriously, if such a ban passes the people of Jackson just need to vote for those folks' opponents next time around.
 
I have friends who live outside Jackson and they say they won't go into Jackson at all after dark, no way, no how. Many areas they won't go to even during daylight hours. Pretty high crime rate for sure. Nice to see they have figured out how to fix that. Maybe that new law would work in Syria too. :scrutiny:
 
Whenever any local government types get up to this sort of stuff - you've learned all you need to know about them.... The only question is when is the next election. If this sort of proposal is coupled with a high local crime rate... that's a very bad sign for folks that live there. Oh yeah.... I want to live somewhere like Chicago.....
 
Scariest city I've ever been in. That is coming from some one that used to go downtown Chicago all the time. Surprised Walter Payton made out alive. No reason to go back.

Yes indeed MS state law is SUPPOSED to preempt these local ordinances, the way I understand it. But getting the powers at be to do something about it seems to be the problem.

For now, I plan to continue to carry on my Enhanced CCW as allowed by state law.

Edited to add that I avoid Jackson as much as I can. I know some good folks down there, but I don't like going there. And if I do go, you can bet I will be carrying, as stated, as state law will allow me.

Mississippi Code

SEC. 45-9-51. Prohibition against adoption of certain ordinances.

Subject to the provisions of Section 45-9-53, no county or municipality may adopt any ordinance that restricts or requires the possession, transportation, sale, transfer or ownership of firearms or ammunition or their components.

SEC. 45-9-53. Exceptions.

(1) This Section and Section 45-9-51 do not affect the authority that a county or municipality may have under another law:
(a) To require citizens or public employees to be armed for personal or national defense, law enforcement, or another lawful purpose;
(b) To regulate the discharge of firearms within the limits of the county or municipality;
(c) To regulate the use of property or location of businesses for uses therein pursuant to fire code, zoning ordinances, or land-use regulations, so long as such codes, ordinances and regulations are not used to circumvent the intent of Section 45-9-51 or subparagraph (e) of this section;
(d) To regulate the use of firearms in cases of insurrection, riots and natural disasters in which the city finds such regulation necessary to protect the health and safety of the public;
(e) To regulate the storage or transportation of explosives in order to protect the health and safety of the public, with the exception of black powder which is exempt up to twenty-five (25) pounds per private residence and fifty (50) pounds per retail dealer;
(f) To regulate the carrying of a firearm at: (i) a public park or at a public meeting of a county, municipality or other governmental body; (ii) a political rally, parade or official political meeting; or (iii) a nonfirearm-related school, college or professional athletic event; or
(g) To regulate the receipt of firearms by pawnshops.
(2) The exception provided by subsection (1)(f) of this section does not apply if the firearm was in or carried to and from an area designated for use in a lawful hunting, fishing or other sporting event and the firearm is of the type commonly used in the activity.
 
There are parts of Jackson you don't go to. The Omni Mall, for instance, is a place only for fools and people who love to have their things stolen. Like any urban place, there are wide swaths of urban decay.

Of course, one of the better gun shows is there. I go from time to time but would never live or work there. Me, I'm getting out into the country.

Oh, and the Fox's Pizza, Shell Station, and Gordon's Ace Hardware in Columbia, MS, do not allow any kind of firearms. Avoid them. Or let them know it's a bad idea to disarm only law-abiding people. Just don't get rude about it.

JRS950 - "Scariest city (Jackson) I've ever been in,"

I've had the misfortune of having to pick up prisoners wanted in homicides I investigated that were being held in Camden and Newark.

If they wanted to give New Jersey an enema, that's where they would insert the tubes!
