FFL Ownership
Speaking only for myself I own most of the guns I advertise and sell. The exception is I infrequently take a gun in on consignment and sell it for a commission for the owner. I would venture to say that most dealers have a variety of avenues of buy and sell.
Circumvent the (good or bad) Law
As a dealer my answer would be NO. I don't know where this would stand with the law but it has the possibility of bringing ATF to my door. The last thing a dealer wants is to be have ATF know that you are alive.
Hyperblole???
I have read most of the 100 posts referred to. I was wondering if any of the reaponders had the misfortune to have to excercise deadly force with the results being the killing of another human being. I believe in the circumstances where your life or the lives of loved ones are at...
Informative
Lets change the facts slightly: Perp breaks into my house, I am upstairs in bed with my gun. They don't come up stairs, I go down stairs If I shoot him where do I stand with the law.
Ship to Address
We only ship to an address that appears on the license as the "Premises Address" or the "Mailing Address" as it appears on the license. This avoids all ambiguity.
Your Liability???
I wonder what your responsibility is in trading it to a dealer or private party knowing the history of the gun and its frequent trips back to Taurus and repeated failures???
Varied advice
You are going to get 10 answers from 5 people. My advice is spend a small amount of money and time locate a lawyer experienced in criminal law and if possible self defense shootings. Follow his/her advice and keep his/her phone number handy.
Welfare Check
Depending on the department they may not do a check since you are not related to the subject. If the people on this forum knew who he is, where he is, they could do some investigation for you. Another option would be to contact a private investigator in his city. For a reasonable...
Help me out here Magic Dragon
If I understand you scenario: I buy a gun on the internet from P&B Firearms, you are my FFL, I pay for the gun and it is shipped to you. I go to you fill out the 4473. Prior to calling in my info you won't let me see the gun. Handle the gun Yes I can see where you...
More than we know
There seems to be some facts we are not aware of nor is the OP. Bikemutt you tried to help but you can't do much if they don't give you all the facts. I don't know how you forget a criminal record!!!!
Receive from Non-FFL
Dirty JIm:
I don't think you will find all FFL's have the opinion you state. As an FFL my only fear is that someday I will get stuck with a lemon I cannot return because the sender is a prohbited person.
Consignment Agreement
What does the consignment agreement say?? If one wasn't made out, what were the verbal arrangements or conditions for the consignment sale???
Right Info
Rhino;
What is the right info you need to accept a handgun from a non-dealer?? Most of the info you get on the gun S/N Model comes after you get the gun. I checked with ATF there is no federal regulation that governs, other than shipping restrictions, the purchase of a handgun or...
Violate the Law
As long as the FFL is not giving advice or direction that would cause a violation of the law I doubt ATF will take any action. Mybe if they (ATF) received many similar complaints they would take a look. FIND ANOTHER FFL.
Call ATF
Calling ATF will do you no good. An FFL has the abosolute right to rufuse to do a transfer. What ever reason, valid or not, he gives is incidental to the absolute right. FIND another FFL.
Advise Officer!!!!
Whether or not you are obligated by law or you choose to advise it sounds like the best policy. To you officers out there, wouldn't you want to know the speeder you just stopped is carrying??
