Article: SCOTUS may be forced to take a 2nd Amendment case sooner than later

Fingers crossed….but then again….be careful what you ask for. I am optimistic however……
 
Hard part is that you need a "damaged" party to define a class to have a legal team bring the case.

All of which occurred, perhaps, 2-3 years' ago to have gotten "up" through the Appeals process to reach SCOTUS.

SCOTUS is presented about 3000-3500 cases per year, and can actually hear about 800-900 of those.
 
There are 6, maybe 7 circuit courts that are all going to be hearing cases on AWB and magazine capacities, many of which may all be wrapped up in one big case, so the chances of an appellate split where one court rules AWB/mag caps unconstitutional, but a different one does and those cases generally get fast tracked to SCOTUS.

I think we're looking at a SCOTUS ruling on AWB and magazines within 2-3 years.

Let's hope Justice Thomas doesn't take any trips to sketchy hunting lodges in Texas and winds up with a pillow over his face.
 
You cannot predict what SCOTUS will ever do. It cannot be forced to do anything. It does not have to resolve differences between circuit courts, and often does not until more than two circuits disagree. Then there is the time factor. In my career as a director of a national trade association involved in numerous copyright action, the organization drove 3 cases to SCOTUS. On average from the date of the trial court decision to the that of SCOTUS’ decision 6 year elapsed. We won 2 and lost 1. We were sure we would win 3. You never know how SCOTUS cases will turn out.

Different kind of SCOTUS we have now compared to those of years past.
 
There is no way to tell what any court is going to do with these highly politicized cases. Sometimes they do the right thing and sometimes they do the politically correct thing.

For a long time some lower courts just ignored the supreme court rulings so the court pretty much had to take up a 2A case to slap down the lower courts that refused to comply with the high courts rulings.
