Braced Pistol stamp Watch Thread

If it gets overturned before you would become a criminal and risk loosing all of your firearm rights, I guess that would be fine.

Keep it after it becomes illegal and taking unnecessary risks doesn’t sound like a good plan at all. I owned SBR’s before the braces existed, so I don’t own any myself but if I didn’t want to register them and they became illegal, I would destroy them (so I am not breaking the law) then buy another one if they became legal again. I don’t know what they cost but I can confidently say none could be valuable enough to put myself into legal jeopardy.
I don’t own any braces or ever bought a brace pistol. I think they look like a 90’s ATI 10/22 plastic stock. I will be summiting forms for 2-3 SBR’s and getting real cool operators stocks. that $600 for 3 Cool Factory Stock not silly velcro thingy

When I get my stamp, I'm gonna swap the stock on my 16" Rifle with my Pistol brace on the SBR. That way I have a legal rifle with a pistol brace and an SBR with a stock. I will immediately then buy a new stock and I'm not sure why I would ever use the pistol brace again hah. Now that I have done one form 1 (assuming its approved) I am just going to SBR every lower I get for complete flexibility.
 
A delay longer than 88 days is an automatic denial and they have photographic evidence you are in possession of an (now) illegal SBR. ATF says they will pursue enforcement.

A photo submission 88 days ago is not evidence that you are currently in possession of an (now) illegal SBR. One could submit the eForm and immediately remove the brace and keep it removed and in a pistol configuration. Or one could add a 16”+ upper immediately after submitting the form and keep it in a rifle configuration with the brace. Or one could submit the form and then decide to destroy the item.
 
I will be removing the brace from the one pistol I have left with one, but I really haven't decided about the 22 AR-15 carbine that has one on it. It just hit the look I was going for perfectly. That may go away as well if I begin to believe the constructive intent arguments are serious. I really am pissed about this though, and don't trust the ATF to actually do what they say. Already have another registered SBR, so I'm not in a hurry to add another. Just going back to pistol tubes. Luckily my only braced pistols were ars, and I wasn't using them as sbr's anyway.

Couple notes from above. My main FFL person went to an ATF Q&A session put on by our local office. Pictures are only supposed to shot the detail of the reciever markings since these will not have to be engraved. The 88-day thing is thier deadline to complete the background check once started, not the deadline from submission. Think about it, how many 6-month to 1 year submissions have there been that weren't auto-denied at 88 days.

I always hated the plastic rubber pistol braces too.

Then I saw the all aluminum Tailhook Mod 1 brace. Bought one for a Mossberg Shockwave, later sold the Shockwave and bought a PSA AR pistol lower to put it on.

I have 6 SBR's already...two are AR's. I submitted a from 1 for the AR pistol Jan 18th. When the stamp arrives, I might just leave the brace on it. I do have an assortment of AR stocks to choose from if I chance my mind.

I already have several NFA items, so registering a few more really isn’t a problem.

My question is, is there a legit reason for this move to make criminals out of law abiding citizens?

Has there been an increase of crimes being committed with braced pistols?

Or is this a move by the ATF or group of politicians to make it look like they’re trying to do something to curb crime?
 
25 states now have a lawsuit against ATF. That’s half, and I’m holding my paperwork now to see how it shakes out. If it’s not shot down before the drop dead date I will make sure my forms are postmarked. Either way I may go ahead and SBR the contender as it’s a super handy woods gun.
 
This probably won't go over very well.....................................but............................

First off, the pistol brace has helped many enthusiasts that needed the help holding/aiming/firing their AR style firearms-----I'm not doubting that one iota, and I am glad those that needed it have been able to continue in the shooting hobby/sport.....

Now, those ( I AM ONE ) that don't need the extra support from the brace, realistically have been using the loophole of the brace to be able to shoulder our pistols legally...........really, tell me if I am wrong/ignorant...

Also, how many that have been on the fence/ hasn't been a top priority, are now going to go out and spend $600-1200 on parts to make a SBR because they can do it tax free for a limited time...........??

I feel that the vast majority of us are law abiding citizens, and will comply accordingly to keep on keepin' on...:)
I have already submitted one eform1 (probably a second soon), happily, so I can continue to enjoy transporting and shooting my short barreled firearms legally. They already have 1 stamp, might as well make it a pairing...

Anyway, take it for what it's worth, this is JMO. I think, in most of our minds, this rule was gonna happen eventually. I guess I'm a little surprised it has taken this long.....
 
me too, i,ll take it off and wait to see how this shakes out. i don,t want a sbr stamp and will destroy the brace if it comes to that.

I fully agree on the sentiment. Just a warning if you want to go out and buy something to get in on the amnesty you are already too late. You would need to have been in possession of it before the new rule was listed to the national registry. If you go buy a stripped lower or a pistol now and make it into a braced pistol there is a form 4473 with your name on it proving that you bought and manufactured an SBR after the date.

I sent in the paperwork for 5 of mine on 1/25. I also bought 6 80% lowers to replace them so if there is ever any reason that NFA items need to be destroyed or forfeited or whatever, they will just get the stripped lowers with no parts in them.

I submitted two “ATF rule” Form 1’s on 14 Jan. They are both still listed as “Submitted/In Process”.

My last 3 Form 1’s (2022) all came back within 2 weeks.

Second, the Dallas office will gladly take any firearm you want to abandon.

Well so does Texas, but I don't call Houston or San Antonio "local" when I'm in a Dallas suburb.......and you wrote "I called several local ATF offices".
 
I did 3 on 2/8 that are in the same boat as yours. What do ya think the hold up is? They waiting for a ruling by a judge or something?

The user submitted their three pistol brace registrations on 01/13/23, with control numbers 20232206XX to 20232207XX. Interestingly, they were all "Approved with Conditions" (namely approved under the provisions of that specific ATF ruling) and also noteworthy, none of them had tax stamps.
This sounds like you get approved, but they are not cutting stamps just yet.
 
Bottom line is that if you do not submit the new Form 1, then you are not in compliance as of today. Yeah, you have until May 31, but I got in early with three of my braced pistols (now they are SBRs).
I also just did a Form 4 for another suppressor.
The AFT will find you if they want to find you. So I submitted the Form 1s and figure I will watch all the litigation on the Rule. My bet is that the Rule will be thrown out anyway.
I personally think the NFA is completely unconstitutional. That is just an ongoing battle.
The thing that irks me is now that these weapons are classified as SBRs, I cannot CCW them in my vehicle anymore (loaded).
