Dick's Enters the Fray

I see this repeated a lot but if you run a business that way, especially retail or otherwise dealing with the public, you are constrained in what you can do regarding customers or risk being sued and/or fined by the government.

For example, Dicks and other retailers do not have total liberty to pick their customers--the federal government and states, counties, and municipal governments have what are called public accommodation laws. These especially apply to retail stores and forbid discrimination involving customers on a whole host of issues. The obvious are covered by the U.S. Civil Rights Act which allows those who were discriminated against to sue the establishment (Heart of Atlanta Motel Inc. v. United States, 379 U.S. 241 (1964)). Another group of customers is covered by the Americans With Disabilities Act. But states and localities have their own anti-discrimination categories as well and these have generally been upheld by courts. For example, California bans discrimination based on political opinion which may get Google into trouble with firing James Damore.

Age is one of those weird categories that is protected in some cases and not in others, depending on the circumstances so an eighteen year old MIGHT be able to sue depending on the wording of the law if the purchase was otherwise valid under state and federal law. However, it might be valid as I seem to remember car rental agencies often have refusal to rent based on age. Too lazy to read up on the caselaw and statutes right now and a lot of it may depend on your state and locality as well.

 

Regarding Dicks, I haven't darkened their doors since they screwed over Troy Industries by cancelling a major contract during their last virtue signalling removal of AR's from their stores. They can go out of business for all that I care.

 

Dicks....names fitting. So another shooting happens and they once again make public statements as a way to grandstand and get free advertising. These idiots need to close the doors and call it quits, but sadly this nonsense seems to work.

And I find it really odd that they don’t sell the guns, but do sell a number of aftermarket accessories. If they really wanted to make a statement they could drop their entire hunting/shooting section but that’s always the busiest section of the stores I have been in. How they stay in business is a mystery to me.

No, I was just being a bit of a wise acre concerning the phrase "assault style."
I can't do much about Dick's .... We don't have any of those where I live. I disagree with what they're doing ... but practically speaking, there's not a lot I can do about it.

 

My mistake in the initial posting, the age they will sell to is 21, not 25 as I previously wrote. I knew that, don't know how or why I put 25.

Dick's has been off my shopping list for years, looks like it will stay that way.

 

I think its good we email them and let them know they wont be getting our money anymore. Also let them know that its not just gun, ammo, and gun related sales. Let them know that you have a wife that does yoga, kids that play sports and you take your family camping. All these type of sales will be lost.

The other side likes to demonize gun owners and when people, companies, etc buy into it, they seem to forget that we're just normal people like everyone else. We spend our money on a lot more stuff than gun stuff.

We at DICK’S Sporting Goods are deeply disturbed and saddened by the tragic events in Parkland. Our thoughts and prayers are with all of the victims and their loved ones.
But thoughts and prayers are not enough.
We have tremendous respect and admiration for the students organizing and making their voices heard regarding gun violence in schools and elsewhere in our country.
We have heard you. The nation has heard you.
We support and respect the Second Amendment, and we recognize and appreciate that the vast majority of gun owners in this country are responsible, law-abiding citizens. But we have to help solve the problem that’s in front of us. Gun violence is an epidemic that’s taking the lives of too many people, including the brightest hope for the future of America – our kids.
Following all of the rules and laws, we sold a shotgun to the Parkland shooter in November of 2017. It was not the gun, nor type of gun, he used in the shooting. But it could have been.
Clearly this indicates on so many levels that the systems in place are not effective to protect our kids and our citizens.
We believe it’s time to do something about it.
Beginning today, DICK’S Sporting Goods is committed to the following:

• We will no longer sell assault-style rifles, also referred to as modern sporting rifles. We had already removed them from all DICK’S stores after the Sandy Hook massacre, but we will now remove them from sale at all 35 Field & Stream stores.
• We will no longer sell firearms to anyone under 21 years of age.
• We will no longer sell high capacity magazines.
• We never have and never will sell bump stocks that allow semi-automatic weapons to fire more rapidly.

At the same time, we implore our elected officials to enact common sense gun reform and pass the following regulations:

• Ban assault-style firearms
• Raise the minimum age to purchase firearms to 21
• Ban high capacity magazines and bump stocks
• Require universal background checks that include relevant mental health information and previous interactions with the law
• Ensure a complete universal database of those banned from buying firearms
• Close the private sale and gun show loophole that waives the necessity of background checks

We hope others join us in this effort to let our kids know that their pleas are being taken seriously.
Some will say these steps can’t guarantee tragedies like Parkland will never happen again. They may be correct – but if common sense reform is enacted and even one life is saved, it will have been worth it.
We deeply believe that this country’s most precious gift is our children. They are our future. We must keep them safe.

Just read the whole thing. Clearly their same old left wing knee jerk reaction. Never shopped there and never will.

 

Let me just suggest that if you want to complain to Dicks and any other store that has joined an NRA or Second Amendment boybott that the most effective thing you can do is:

• Send an actual letter to the corporate headquarters. The fact you took the time to write the letter and spent 50 cents to send it tells the company you have more invested in what you're saying than cheap electrons.
• Be polite.
• Let them know that you don't want to support a company that is working against the gun rights of their law abiding customers, but should they decide to reverse course, you will consider returning.

Telling the operator of a Big Box store that you will never enter their doors again in a fit of pique is something they will regard as nothing more than bravado because needing that pair of cleats for the kids at the last minute will probably bring you back - eventually. Plus, are you going to be true to your pledge to never shop there again if they change their mind? We want to welcome back people who see the error of their ways, not brand them forever.

Nothing but a repeat of their last publicity stunt to attract more of the yoga pants/mats/squash and racquetball crowd looking for designer "outdoor" wear that's got popular brands but functionally isn't worth a damn. I've got a kitchen pantry stocked better than any of Dick's gun departments.

 

And I believe that is cultural. People take responsibility when they have to, and I think 18-year-old brains are quite capable of rising to that challenge. If they're not, then we shouldn't be letting them in the military either.

I'm not disagreeing with you -- I think we're on the same page in not seeing the need for the change.

 

The Dick's where I recently lived hasn't carried AR15s forever it seems, the one where I live now doesn't either. In any event, I bought a couple long guns there a couple years back, on close-out. Their merchandise while of decent quality is generally overpriced. I cancelled my Dick's rewards card and credit card which I'd signed up for just get another whatever discount off the long guns I bought back then.

This is the last time I'll ever mention DIck's again, they are dead to me.
