Did Sportsmans Guide Break the Law?

The only problem I have with no signature is when they deliver the stuff to the wrong address. Years ago I lived on East 20th street, but my ammo was delivered to West 20th street. The only thing I got out of the carrier was that it had been delivered. Luckily for me the people who lived at West 20th were nice enough to get in touch with me, and made sure I got my package.

BATF could care less. There was no violation of their regulations.

The Department of Transportation, on the other hand, would be interested. What Sportsman Guide did was a violation of Federal Hazmat Law in that they made an undeclared hazardous materials shipment which would subject them to civil penalties of at least $15,000.00 a day for each day the shipment was in transit. It sounds like one of their employees screwed up and I'm sure the company would want to know about that.
 
I almost broke my leg coming into the house at 1230am this morning why? UPS had left my order of 15k primers right before the stairs to my house. I was happy to find em there.

if you don't want them to do that... don't order online...

or have you orders held at the distribution center and go pick them up.
 
All the ammo dropped at my house over the years has never had a signature signed. Shhhhhh. Don't tell the anti's. My UPS store is like 8 miles from my house and I don't want to drive there every time to pick up packages.

That is a common misconception but is not true. The misconception comes from the fact that HAZMAT charges are not usually assessed on ORM-D shipments.

ORM-D (Other Regulated Material-D) is a Department of Transportation hazardous material class and is subject to the hazardous materials regulations. All the ORM-D does is give certain exemptions to some marking, labeling, and shipping paper requirements. All other portions of the hazardous material regulations are in effect.

Also, small arms ammunition is classed as a Division 1.4G explosive material unless the ORM-D exception is taken.

I have been a certified hazardous materials, hazardous wastes, radioactive materials, explosives, and ICAO/IATA dangerous goods shipper for many years and believe I know what I am talking about.

I have ORM-D packages left all of the time. It works well for everyone involved. I don't wait another day for my stuff and the UPS guy (sometime girl) does not have to tote all that weight back to the truck. :)
 
I met the FedEx guy at the door Monday. He had dropped a large ORM-D package on the step and headed back to his truck to get his signature book. I had to sign for the Whisper-2 earpiece I had also ordered.

AFAIK a signature is not required by law.
The shipper may request signature delivery, but places like SG usually do not as it costs more.
If the the shipper requests and pays for signature delivery and the driver leaves it without one, then you should call the driver's terminal and file a complaint.
 
Did you not receive the product you paid for in a timely manner?

I wouldn't even worry about it. I'm just saying.

I just ordered 300rnds of 7.62x54R for my Nagent from Sportsman's guide. I expected it to come UPS and shipped "Adult Signature Required" like wine or mail order prescriptions come.

Did you pay the extra fee for the adult signature requirement? It isn't free.
 
I was under the impression that all Ammo had to be labeled ORM-D and required an adult signature.

Among the 2 pages of arguing here let's make sure it's clear.......

There is no legal requirement for signatures.

It is the ammo sellers responsibility to ensure that the buyer is of age to buy the product, the shipper has no involvement.

I do not get items shipped to my home because I want to receive them. If we are not home, and UPS or FEDEX leave stuff on my doorstep, and it is stolen, it is tough s**t for me. I get everything shipped to work, so I make sure I receive my order. Even if I am away, someone is there at the office, and they will put it aside until I return. Usually, I get questions about the heavy boxes. I just say they are machine parts for the job or car parts.
 
If you guys are looking for an ammo deal SG is having a deal where shipping is free on your first order is you sign up for the buyers club. The membership is 35 bucks but this means you get the buyers club price on the ammo and free shipping which saved me over 30 bucks when all was said and done for 400 rounds of 7.62x54. The downside is SG plays a little fast and loose with your personal info. All is needed to check the status of your order is your last name and zip. If an enterprising crook lives in your area and trolls your last name he will see you order for 90 days and it even displays your address for his thieving convenience. I, and others, have contacted them about this and they show no intention of changing this practice. If you have an odd last name there isn't much risk but if your the only Smith or Johnson in the area that has ordered your name, address, and teh mature of your order will be there to display.
 
Being of age to have a credit card, with VERY few exceptions, means you are also of legal age to purchase RIFLE ammunition; in those rare cases of an under-18 with a credit card, an adult is responsible for the account and said adult is legally considered to be the purchaser. The only real legal restrictions are on pistol ammunition, where they MUST verify your age. Pistol ammo is thus probably shipped signature-required, but not rifle ammo. Note that signature-required is an added shipping expense. If you don't pay for it, you don't get it.

UPS may have reboxed the ammo if they thought the original box would not survive transport or they damaged it somewhat. It is likely that SG actually did it correctly.

Note that a shipment I got from AIM Surplus of 7.62x54R also came sans signature and was drop-shipped to my front door, so this is common practice.
 
ups and ammo

ups has no way of knowing what is in the package was it an ormd or did it just have a ground service level marking on it . having worked for big brown i can tell you after the first two days you stop caring whats in the package unless it is leaking or on fire. as for sportsmans guide if you paid with a credit card they may have used that as proof of age why do they need a sig.... just a thought.
