Evil bad mean Black Rifle... AR-15 project - NY input requested

Ok folks, need some input here.... I've got the itch. I've been working the past many months on my Sistema and have it built up into a fine sidearm. Now that it is complete I need a new project build. (trust me if I don't have a project I get into trouble :D )

So I've settled on the classic platform of the AR-15. My gun safe just looks empty without one. I am not a person who will just purchase any old rifle, as a good friend of mine said "bought myself a DPMS and rebuilt the %#$$%$# thing, should have started from scratch". ...and it wouldn't be a project if it wasn't built in my own shop.

Now, the issue is where this starts. I am in New York state. I've been reading over the State laws regarding assault weapons and I'm not sure if I can even start this project.

My concern is that the "Colt AR-15" is specifically mentioned in paragraph 22d (pg 296), so is that excluded already for any AR-15 by any name (AC-15, etc)?

Regardless my options for a build are limited, as it has the detachable mag and pistol grip, so I can't use a 4-position stock, or bayonet, or flashider, etc etc etc.... :barf:

10-301 Control and regulation of the disposition, purchase and
possession of firearms, rifles, shotguns and assault weapons.
Definitions. Whenever used in this chapter the following terms shall
mean and include:...

...16. "Assault weapon."
(a) Any semiautomatic centerfire or rimfire rifle or semiautomatic
shotgun which has one or more of the following features:
1. folding or telescoping stock or no stock;
2. pistol grip that protrudes conspicuously beneath the action of the
weapon;
3. bayonet mount;
4. flash suppressor or threaded barrel designed to accommodate a flash
suppressor;
5. barrel shroud;
6. grenade launcher; or
7. modifications of such features, or other features, determined by
rule of the commissioner to be particularly suitable for military and
not sporting purposes. In addition, the commissioner shall, by rule,
designate specific semiautomatic centerfire or rimfire rifles or
semiautomatic shotguns, identified by make, model and/or manufacturer's
name, as within the definition of assault weapon, if the commissioner
determines that such weapons are particularly suitable for military and
not sporting purposes. The commissioner shall inspect such specific
designated semiautomatic centerfire or rimfire rifles or semiautomatic
shotguns at least three times per year, and shall revise or update such
designations as he or she deems appropriate.
(b) Any shotgun with a revolving-cylinder magazine.
(c) Any part, or combination of parts, designed or redesigned or
intended to readily convert a rifle or shotgun into an assault weapon.
(d) "Assault weapon" shall not include any rifle or shotgun modified
to render it permanently inoperative.

I don't see anything outlining specific makes or models...

Honestly, you can buy or build a very nice AR without those things. The only thing that is actually functionally useful for a civilian is a flash hider, but it's not the end of the world if you don't have one.

I have this AR that I built during the AWB. It's still one of my favorites. One of my carbines now has a fixed Cav Arms C1 stock after I realized how much the collapsible stocks suck.

Mannix I stumbled across that as well, but yes it's there on the NY State laws Laws Search >Penal Law § 265.00 PEN Part 3 Title P Article 265

(d) any of the weapons, or functioning frames or receivers of such
weapons, or copies or duplicates of such weapons, in any caliber, known
as:
(iv) Colt AR-15;

...bleh

So I was already looking along the lines of the DMK rifle shown above, fixed stock etc and using a sad little 10 round magazine.... BUT

I was just hearing about a new law that may have passed the house and is in the senate, somewhat of a mirror of H.R. 1022 by NY's own version... Spitzer has already said he would sign it in??

So is this rifle just destined to be an evil bad thing in NY state?

as of now you can build some nice NY rifles with parts like ace or vltor stocks, muzzle brakes (phantom and tromix to name 2) and plenty of other accessories.

As HardKnox said, The reason you didn't hear about it is because it is not a law yet. According to the bill summary, it passed the Assembly in April and was referred to the Senate. I did a little hunting around and it seems that a similar bill that was introduced in the Senate never went anywhere. Thankfully, the legislature will be going out of session in the next couple of days and it is really doubtful that the Senate bill will be passed, the Senate and Assembly versions reconciled and then sent off to the Governor for signing.

But still, it will probably come back around so keep an eye out.
 
Well, my question gets more to the point regardless of the proposed legislation, it is on the question of the AR-15 as mentioned in the law. Since it says "Colt AR-15" does that mean that ANY AR platform is just an assault weapon by name alone? I've spoken to people who view the words as that, and others who say that they don't own an AR-15 but an AC-15, etc etc....
 
This type of thread pops up now and then and you're going to get a slew of "no, you can't even own a bolt-action rifle" crap from Non NYers. Here is how the laws in upstate NY work:

The NYS assault weapon ban is a mirror of the old federal one. You cannot build a COLT AR=15. You could however, build up a Bushmaster XM-15, RockRiverArms gun, etc. Because it is NOT a COLT AR-15.

Whatever you build must not have the evil features: no collapsing stock, no bayonet lug, no threaded barrel.

I am 100% sure of this, I almost had to move back to upstate NY a year ago and checked in with the Rochester, Buffalo, and Ithaca PDs, as well as the BATF. Just pretend that you live in an alternate universe where the AWB never sunset... because that's essentially what you live in. Basically you can build what DMK has.
 
As long as the lower receiver (the part legally considered the "gun") isnt Colt, you're good to go.

Remember, the letter of the law is the law. Otherwise it would have been worded something like, "AR15/M16 style firearms, all derivitives and variants thereof, regardless of manufacturer."
