A federal appeals court, in a case that has pitted the First Amendment against the Second Amendment, sided Thursday with free speech.

The 11th U.S. Circuit Court of Appeals ruled Thursday that Florida’s so-called “docs and Glocks” law, which prohibited doctors from asking patients about guns in the home, violated a physician’s free speech rights.

The court upheld only one portion of that law — the part that said doctors could not discriminate against patients because of their support of the Second Amendment right to be armed.




 
I have no issues with DR's asking if someone has guns in the home. The patient can choose to answer or not. If the information is used appropriately then it can be useful. But if done inappropriately there should be consequences for DR's who abuse the information. It is no different than the HIPPA requirements all medical staff are held to.
 
Get another Dr. I ride hogs with 3 of my doctors to the shooting range every 4 to 6 weeks. Good Doctors are out there, just hard to find.

It has nothing to do with healthcare.

"Do you have guns at home?"

"Doc, I thought I was here for a physical?"
"Doc, I thought I was here to get my hurt arm looked at?"
"How about those Cowboys Doc?"
"That's right Doc, it hurts right here."

Lot's of choices, you are in no way obligated to answer, and simply changing the subject is always a good approach.
 
Well having had 4 back surgeries in the past few years I can tell you...yea it can make a difference.

Doc....you shoot don't you
FP...yea....what tipped you off.
Dog...the 2nd amendment is not about duck hunting t-shirt you have on.
FP...oh...guess that is why you are a doc...you iz smart.

Well that is mostly true...I was not wearing a tshirt....but had the same reaction when he asked me....once and a while...and why do you need to know that....he gave me the answer.

Prone is still very hard on me...it puts pressure in just the wrong places and I have lost some range of motion in my neck.

I would say it depends....I would think of my family doc as a friend....hell I still see him once a month for blood tests for the meds I have to take....make sure my liver is not going nuts.....but in that case and other cases yes I can see how they would need to know....they also banned me from motorcycles for about a year.....any little hit and anything below the neck no workie....even my fun parts....I did not think they had anything to do with nerves....well they don't your brain can make it work....but usually it takes some outside forces to get the little soldier to stand at attn. So after learning all that....yea I will not shoot and I will stay off the bike.

Don't be so quick to judge....yes I agree if you are going in for a flu shot they don't need to know.....and you can likely say in truth yea I shot a friends gun once and a while.
 
Have never had any doctor (or for that matter any medical personnel), ask me that question. If they did I would answer "no" and go from there. It's simply none of their business and has nothing to do with why I'm there.
 
Doc, when the AMA starts doing gun classes and the NRA starts doing brain surgery. At that time I will discuss if or if not I own guns. Till then -----------

Neither have i.

Florida political hacks passed a piece of feel good stuff. Not surprisingly it got shot down by the courts.
 
It is for the safety of the little children.
Don't ask don't tell works for me. I think this was more an issue with pediatricians and safe gun storage.
I'm not at all in favor of people, no matter what degree they hold, that have no experience with firearms trying to educate me about them. The other issue is after my PCP has my gun ownership on record, when will s/he decide I am mentally incompetent and should have my firearms confiscated, you know for my own good and the safety of the community.
 
Prohibiting doctors from asking patients about guns in the home is a violation of a physician’s free speech rights? Are you kidding me? Sounds more like an invasion of privacy to me. I assume then I am fully within my "free speech rights" to tell said physician to pound sand.
 
Doctors aren't law enforcement officers. They ought to be able to ask whatever they want. And patients ought to be able to able to refuse to answer or find another doctor.

Taking away a private physician's free speech rights ain't the answer. This wasn't a hard case.

Doctors should be allowed to ask. They shouldn't expect an honest answer though. What they really should not be allowed to do is keep a written record that is then shared with governmental or state agencies, insurance companies, or others that may put your privacy at risk.

Well, they can expect whatever they want. ;) What they will get will vary wildly by patient and by the rapport with the doctor. I have told my primary care physician that I'm a competitive shooter because I want him to check my lead levels at my next physical. His reaction was not "oh, guns are scary." He asked which range(s) I frequented. Interesting dude. Keeps dogs in the office for patients to pet. Comes across as very hippy/new-age, but is totally OK with guns. No longer takes insurance of any form; you just pay him $X for the year and he takes care of your primary care needs.

I've been lucky, most of my docs who ask about my guns due so because they are interested.Some were shooters before I met them and a couple are new recruits. Once they start to shoot and consistently hit the target it's a big attitude change.....When I go to their office they greet me with questions like any new toys or when are we going to the range again? A couple have recently inquired about the Peace Keepers and the 3%ers..................
