All paperwork done to get my draco sbr work completed.Before I send it in with a 200 dollar check I have one question.If I have a long enough flash suppressor soldered on the bbl to make the unit come to 16 1/2" and then add a folding stock on it would that be legal and not need to go thru the atf for a stamp?It would not be a SBL dut to the permanatly attached flash suppressor.

You are correct. If you plan on building a rifle with a barrel 16" or longer out of a pistol, it's fine without submitting a 5320.1

However, you won't be able to put it back into pistol configuration, because that would constitute a weapon made from a rifle which is an NFA item.

Adding a stock to a firearm formerly classified as a pistol would require the tax stamp. Even if the rifle had a 16.5 in barrel.....which you won't find on a Draco.... you've created a rifle from a pistol, making the tax stamp a requirement regardless, at least as I understand it. If you are going to have a 16.5 in barrel, you're better off just buying a rifle version of the AK that already comes with a 16 in barrel, eliminating any NFA problems. Theres no real point into pinning on a flash hider that brings the barrel length of a Draco equal to that of a standard AK, unless theres something I'm just not understanding about your post. Making a Draco into a rifle...but with a barrel length of 16 in plus....just seems to be an exercise in futility and wasted money. A draco SBR makes sense....a Draco rifle with a barrel as long as a standard AK, and a redundant $200 tax stamp........well, not so much

This is backward. There is nothing in the U.S. code about making pistols into rifles. That is fine, legal, and you don't have to tell anyone anything about it.

It's the OTHER way that becomes a problem.

The only reason it is a problem is that the text of the National Firearms Act of 1934 uses the phrase "firearm made from a rifle." If you start with a rifle and make any concealable (less than 26" OAL and/or <16" barrel) firearm from it, that's a Title II regulated firearm.

Making a Draco into a rifle...but with a barrel length of 16 in plus....just seems to be an exercise in futility and wasted money.

Remember that a rifle has to have a barrel that is at least 16" -- not including any removable muzzle devices. Some of the AK style flash hiders are pretty long. If you go with a shorter barrel and a permanently-affixed flash hider you can make the TOTAL length 16" which is considerably shorter than a standard barrel + additional muzzle device.

And, you can get that without the $200 stamp and paperwork.

Further, a Draco is a fully-functional Kalashnikov, built on a new-manufactured factory receiver and barrel. That's a very good thing. It is importable (because it's a pistol) without chopping up the receiver and barrel and rebuilding it as a parts kit gun. So in building a rifle on one you get about the best "bones" you could have to start with.

The redundant tax stamp makes no sense (not sure you could even get one if your gun isn't in a Title II category) but the rest of it could make plenty of sense to someone who cares for such things.

I already have a draco and a 5 1/2" flash hider.My thinking is why blow the 200.If I go the tax stamp route I would never sell it easily if I decided to.Adding the 5 1/2" FS makes it a legal length.I only paid 200 for the draco and 25 for the FS.Adding a stock for about 150 and I'm good to go and legal,and no need to get the govt involved.
