Florida bill questions?.....

Could you explain briefly what this new bill is? Does it involve CCW/W licenses during declared state or federal emergencies? Gun sales? Open carry? :confused:

Tomorrow afternoon (Tuesday April 8th 2014), Senate Bill 296 by Sen. Brandes will be before the Florida Senate Community Affairs Committee.

This is the bill that the Florida Sheriffs Association (FSA) has been using to fight against the very core of your right to bear arms.

At the request of the FSA, two amendments have been filed that would gut the bill's protections of your right to bear arms during an emergency evacuation. An almost identical North Carolina law to the one that the FSA is trying to keep on the books in Florida was ruled an unconstitutional violation of the Right to Bear Arms in federal court.

Well, that didn't really explain what the bills DO. "Gut your right to bear arms" sounds very intimidating and bad, which makes me think there is some hyperbole involved. What does the bill actually do?
 
The part of Florida law that the FSA is trying to save prohibits all public carry of a firearm during an emergency. No exception even for a CWFL.

We're trying to create an exception for people who are evacuating to this law:

870.044 Automatic emergency measures.—Whenever the public official declares that a state of emergency exists, pursuant to s. 870.043, the following acts shall be prohibited during the period of said emergency throughout the jurisdiction:
(1) The sale of, or offer to sell, with or without consideration, any ammunition or gun or other firearm of any size or description.
(2) The intentional display, after the emergency is declared, by or in any store or shop of any ammunition or gun or other firearm of any size or description.
(3) The intentional possession in a public place of a firearm by any person, except a duly authorized law enforcement official or person in military service acting in the official performance of her or his duty.

I can agree with the points in theory but to me the new Florida law(s) are a non issue since I already have a valid Florida W/CCW ID(onfile with the Florida Div of Licensing). In a declared state/federal emergency Id already have my state CCW card on me, so any weapons-ammunition concerns would be covered.
The one video stated about 20% of Florida gun owners have valid CCW/Ws. :confused:
That stat may be true but a Florida W license isn't super expensive or complicated to obtain. www.Mylicensesite.com
To me, a valid or important point of this new law/bill should be mandating that all sworn LE agencies in Florida get in-service training re: carry laws, weapons(to include chemical agents, EDWs/Tasers, impact weapons/batons, etc). The FDLE(Florida Dept of Law Enforcement), had training & orientation programs for cops but cut the funding. :mad:
FDLE & the state Div of Licensing need to work together to avoid problems/conflicts that will come up with declared emergencies or major events(like Katrina, Rita, Ivan, Super-Storm Sandy, Joplin MO, etc).
I've been thru 2 major hurricanes in central Florida in 2004. It's not fun. Everyone's nerves get strained & 911/first responders aren't always available.

PS; it was entertaining to see Marion Hammer in action. :D I enjoyed the part where she took apart the lightweight from the Florida Sheriffs Assoc.

Your concealed carry license won't help you under this law. That's part of what the new bill, without the proposed amendments, will fix.

I still say 2A groups & concealed carry supporters should address the issue(s) of mandated(in service) training for Florida sworn LE officers re: FS790 & FS493.
The cops will say; "no one told me" or "we didn't get any FDLE training" or "our union rep/shop steward never said that" :rolleyes:

The Div of Licensing needs to be more involved too. 1000s of new W/CC licenses & new G licenses have been processed in the last few FYs.
You can't tell me the Div or the Florida state government lacks the $$$ for these programs/resources.

To my understanding the sunshine state now has a budget surplus. ;)
 
Considering I have lived in a location that gets evacuated for EVERY hurricane that hits, I really support this bill. While it's not an "end of the world" scenario, post hurricane blackouts are scary. People do take advantage of the evacuation and stay behind to take stuff. Food becomes scarce for those that can't afford to get generators and such. Stores sell out of canned food rather quickly, and those that aren't relatively close to a hospital can be without power for weeks so say goodbye to anything that needs to stay cool. When the back to back hurricanes hit, we were without power for over a month. Many in the western part of the county have well water, so no water if the power is out. FEMA brought water to the fairgrounds...there were lines of people waiting hours for water, and you did have to worry about your supplies being stolen.

Katrina really showed us how thin that line is between order and chaos. Essentially they are denying rights at the time that you logically need them the most...don't let this happen in Florida...
 
Rep Bobby Jindal(R-LA)?.....

Correct me if I'm mistaken but didn't Rep Bobby Jindal(who later became Gov) get a federal law past(signed by President Bush) that prevent gun confiscations or sworn LE/activated military troops from arresting gun owners/citizens in declared emergencies like Super Storm Sandy or Katrina?
I don't know the exact law or bill but I think NOPD's Chief Eddie Compass & his shenanigans had a lot to do with it. :cuss:

EDIT; I did some checks online, it's the Disaster Personal Protection Act of 2006. That's the bill Rep Jinal sponsored.

So it sounds like The Disaster Personal Protection Act would trump any state or local laws?
It does have the provision that they can confiscate as a requirement to enter a vehicle for evacuation (so to get on a bus/truck for evac you need to leave your gun). Could law enforcement require you to evacuate? (It's not right but I would guess they can).

Regardless, in an emergency situation the last thing I would do is give up my firearms, and live (or not) with the consequences.

I'm confused by what legal weight a Florida W(concealed license) would have in a declared emergency(state or federal). Are DOACS occupational & W licenses legally suspended during these times?
Would a cop or activated NG soldier "disarm" any Florida citizen with a weapon?
Id think that is where the Bobby Jindal law comes into it.

It's all very complex re: natural disasters & declared emergencies. :mad:

One point Id add for Florida residents & tourists, in the wild & wooly days of the hurricanes of 2004, the Florida Highway Patrol public affairs troopers said repeatedly that all FHP vehicles would be taken off the Florida roads/highways if the wind speeds were 50mph or higher. :uhoh:

That's no comfort if you are in a confrontation with armed looters or tweakers/junkies who want your property.
