Gun store cannot be closed

    On local TV news tonight. A Springfield, Missouri gunstore that was initially told to close because it was not an “essential” business, has now been informed it can continue conducting business. The indoor range is closed but something about constitutional rights caused local authorities to reconsider. Restricting the right to purchase guns and ammunition, apparently raised some interesting questions. Curbside service, but still operating.

    Midway USA is still open.

    It seems like anything except bars and restaurants are open. I feel for those owners and employees.

    Even in the communist state of Colorado they are allowing gun stores to remain open.

    In PA the Governor’s shutdown order included gun stores on Monday. On Tuesday they on th exceptions list, and now LGS is open. It is do busy that the will only allow 10 customers in at one time. Those who go there get a number and cannot enter until their # is called. They sold out last week and just got big order in. I am going to ride by tomorrow and see what the parking lot looks like.

    one thing I read, and I cannot verify it, was the Gov was influenced by this argument. What if state, county, and local LEOs contract the virus and say 40% are infested or quarantined? Response time will decrease, manpower might not be enough to cover the number of incidents requiring a response, and deteriorating societal conditions might leave people very exposed.

    LEOs cannot always socially distance. Their human contact is up close usually. They are very susceptible to the virus. So now we have another good reason to fight for 2A. Our well being un our hands.

    Yup- Funny that of all states, we had no legal controversy about it. Even Boulder County's home grown "stay at home" order specifically exempted gun stores by name from first issuance.

    It may already be happening. Cincinnati PD has publicly announced they are curtailing responses to a list of minor crimes to protect officers from the virus. I think I read something similar about New Orleans or someplace.

Isaac initiated a review of essential Patrol functions and developed a Differential Response Plan with the Emergency Call Center (ECC) regarding calls for service in an effort to reduce unnecessary contact between officers and the public to reduce the spread of COVID-19.

    Effective at 8:00 a.m. Tuesday, March 24, 2020, a temporary suspension of in-person officer response will be in effect for the below listed Calls for Service:

    Referred For Online or Telephone Reporting:

    ■ Assault Report (no medical attention necessary and suspect is no longer present)
    ■ Breaking and Entering Report (where no suspect(s) or possibility of property recovery)
    ■ Criminal Damaging
    ■ Dog Bites
    ■ Lost Property
    ■ Lost or Stolen License plates
    ■ Menacing Report (unless suspect is expected or threatens to return or is part of the elements of Domestic Violence)
    ■ Phone Harassment
    ■ Property Damage

    In Washington they've deemed gun stores as none essential, they are supposed to close.
    Most of the things listed above wouldn't get a police response in normal times. They would tell you to come in & fill out a report.

    I know here in Missouri there is a specific state law that prevents the state or any local government from doing things like this. It is Mo statute 44.101

    44.101. Firearms and ammunition, state of emergency, no restrictions permitted. — The state, any political subdivision, or any person shall not prohibit or restrict the lawful possession, transfer, sale, transportation, storage, display, or use of firearms or ammunition during an emergency.

    On the Federal side there is:
    42 U.S. Code § 5207.Firearms policies
    But it only covers federal officers during a general emergency and there are quite a few exceptions where they can seize guns.

    I guess those in Colorado know Colorado's gun laws but when it comes to buying, using, carrying(as in OpenCarry)..a gun in Colorado..I'd hardly describe it as a
    'communist state'...
    Go to LGS, walk out with 'approved' gun, in about 15 minutes..only done that about 15 times, and most in Boulder...

    GunSport in Boulder still open...

    Gun stores are open in most towns in California.
    The Los Angeles County Sheriff tried to close stores but the County Attorney’s Office shut him down. Rightfully so.

    This has a direct connection to my post #4 above. Just heard that 11% of NYC PD is out with confirmed or probable Corona Virus. One LEO has died from it.

    in NH yesterday the Governor said something along the lines of - it is considered essential for people to have the ability to defend themselves - so, gun stores are essential and will remain open.

    For now. The Colorado state government has a way of going against the will of it's citizens. They just passed anti oil and gas laws that the citizens had just voted against. They recently replaced Columbus day with a more anti American politically correct day of celebration. They are a little skittish on guns because of the backlash from the last gun control law that banned magazines of more than 15 rounds. Several senators were recalled for voting for the ban. However no changes to the laws that were put into place. Guns are on the radar of our state politicians. They will push us in the direction of California. Don't get complacent just because things work just fine now.

    Cops came by and closed our local firearms dealer down . It's not essential. Lots of things have changed in NM since the new guv that's turned into a dictator came into office.

    Bexar County, TX implemented a lockdown order 23:59 hours on Tue. Among other things, liquor stores and golf courses were exempted from closing down for the duration. My LGS in Hill Country Village, TX was allowing one customer into their shop at a time, and keeping the door locked other than entry & egress. The local PD shut them down Wed for doing this. Guess they saw cars parked in front of the shop from the expressway. Thursday the owner announced he was able to discuss this further with the PD leadership, and now they're allowed up to 2 customers in the store at a time, one at each counter along the left & right walls. I have an item I plan to pick up tomorrow afternoon there.

    And this is deep in the heart of Texas! Golf courses allowed to remain open from the get-go . . .

    Ironically, Coyote Creek outfitters in Rochester NH has had its gates shut for the past week, and the Maine governor has determined Kittery Trading Post as “non-essential”....

    Then work to replace those via the next election that you agree with. Against the will of 'some' of their citizens. NOT gonna get into something so obscure as 'Columbus' and how he did business. NOT 'anti american' at all.

    Maybe, maybe not. Gun stores have NOT been closed by Governor Polis. MANY RED states HAVE closed gun stores.
    BUT 'direction of California'...don't see that right now not do I expect to see it.

    Texas is not the firearms friendly paradise many believe it to be. It's not the worst state in the nation but not close to the best either. That's one of the reasons I no longer live there. I'm retired and own property there but the place has enough things I dislike to ever return.

    I just read the VRA has sued CA and Second Amendment Association has sued NJ to have gun stores exempted from closing. Both orgs are planning on suing additional states.
