PA HB2436 has been introduced. While the bill has no text yet we have some inside information about it.

This bill is actually a 'smack down' for Bloomberg backed Attorney General Kane who has recently decimated reciprocity agreements from several states in what she calls 'closing loopholes'.

Here is a memorandum from Representative Will Tallman outlining the details of the bill:

In the near future, I will introduce legislation to provide the Attorney General some much needed guidance when reviewing other states’ laws for the purpose of recognizing each state’s license to carry a concealed firearm in Pennsylvania.

The law in Commonwealth requires the Attorney General to make a determination that “the firearm laws of the state are similar to the firearm laws of this Commonwealth.” (18 Pa.C.S. § 6106 (b)(15)(ii)). This has been in statute since the passage Act 66 of 2005; and generally, the law has worked fairly well for nine years.

Recently, however, the Attorney General as interjected certain political motivations into the process of determining whether the laws of a state are “similar” to Pennsylvania’s. My legislation will give the AG the guidance she needs to focus her analysis on the substance of the law.

Specifically, my legislation would limit the analysis to thirteen criteria (which are already utilized in determining whether someone is eligible to obtain a Pennsylvania carry permit). The AG would need to determine whether the other state’s law prevents any of the following people from obtaining a carry permit:

An individual whose character and reputation is such that the individual would be likely to act in a manner dangerous to public safety.

An individual who has been convicted of a drug offense.

An individual convicted of the types of crimes that would prevent a person from possessing a firearm.

An individual who, within the past ten years, has been adjudicated delinquent for a serious crime (like those enumerated in section 6105 or for an offense under The Controlled Substance, Drug, Device and Cosmetic Act).

An individual who is not of sound mind or who has ever been committed to a mental institution.

An individual who is addicted to or is an unlawful user of marijuana or a stimulant, depressant or narcotic drug.

An individual who is a habitual drunkard.

An individual who is charged with or has been convicted of a crime punishable by imprisonment for a term exceeding one year (with exceptions for offenses in which the disability has been waived or the individual received a pardon).

An alien who is illegally in the United States.

An individual who has been discharged from the armed forces of the United States under dishonorable conditions.

An individual who is a fugitive from justice (not including nonmoving or moving summary vehicle offenses).

An individual who is otherwise prohibited from possessing, using, manufacturing, controlling, purchasing, selling or transferring a firearm under state law.

An individual who is prohibited from possessing or acquiring a firearm under the statutes of the United States.

Washington State

I-591: Bill would forbid seizure of firearms "without due process" during state of emergency. It would also require that the state follows national standards with reard to background checks. Essentially a one-page counter-bill to the 15 pages of the I-594.

I-594: Bill would require background checks for all transfers and require that they be completed by an FFL. I beleive there are some storage regs thrown in too, see the thread about it for more details...oh, and Bill Gates just tossed in $25k

Couple of new pieces of legislation for Michigan today.

HB5749 would repeal MCL 752.891-752.892 which bans anyone under 18 from shooting a BB gun

SB1028 would prohibit employers from banning firearms in employees vehicle on company property as long as the employee has a concealed carry permit.

Michigan HB5748 changes one line in MCL 28.422 from

(d) The individual possesses the pistol for a lawful purpose as that term is defined in section 231a of the Michigan penal code, 1931 PA 328, MCL 750.231a.

to

Well New Jersey is at it again:

A3697 has no text yet but the summary states 'Prohibits investment by State of pension and annuity funds in companies manufacturing, importing, and selling assault firearms for civilian use.'

A3644 would remove the prohibition of 'stun guns' by the public

S2355 would make firearms training a requirement before being able to apply for a firearm purchaser identification card

First he is attempting to rewrite mental health procedures and references to title 18 in SB1470

Then in SB1471 he is attempting some creative re-writing of title 18 itself

HB5555 description states 'To prohibit the Federal Government from requiring race or ethnicity to be disclosed in connection with the transfer of a firearm.'

Michigan HB5887 has been introduced and it is indeed an interesting bill.

Essentially it would make it a crime for any employee of any of the following federal agencies to carry a firearm in the state in the course of their employment with the agency except the following agencies:


(i) The United States department of defense.
(ii) The United States department of justice.
(iii) The United States department of homeland security.
(iv) The nuclear regulatory commission.
(v) The United States capitol police.
(vi) The bureau of diplomatic security.
(vii) The central intelligence agency.
(viii) The military departments, as that term is defined in 5 USC 102.

You got that wrong. The bill exempts those agencies from the law. All other federal agencies would be the ones that could not be armed in the state.

Heads up Pennsylvania people. There is movement on HB1243.

We just got a report from Harrisburg, Senator Farneze is attempting to amend the language of HB1091 to this bill. If he is successful the bill would have to go back to the house and there is no time for that.

Secondly the judiciary committee will hold an 'off floor' meeting about the bill today. Greenleaf has NEVER held this type of meeting for a gun-related bill so something is afoot.

Besides calling your senators there's one man that can move this bill and move it fast, that's senator Pileggi.

Emails are ineffective at this time, we need phone calls and we need lots of them to get this bill going.

When calling please tell his staff you want HB1243 moved to the floor for a vote and voted on CLEAN (no amendments)

Today's the day please pick up the phone and call or fax his office now.

Pennsylvania people ... we need all hands on deck today!

If you have been following the insanity in Harrisburg you know the language of HB2011 (strengthening preemption) has been amended to HB80 and was passed by the senate last week. The bill in now in the house for the final concurrence vote today and is sitting in the rules committee at this very second.

We learned late last night that a conglomeration of anti-gun groups intend to converge on Harrisburg today. The groups include Moms Demand, CeaseFire Pa, coupled with PETA and several other smaller groups. Their intention is to do anything they can to sabotage HB80 (preemption) while pushing through HB1750 (pigeon shoot ban). They may also be bringing in some 'heavy hitters' to help (rumors of Jesse Jackson have been floating around)

How they intend to do this is to lobby the house rules committee to push out HB1750 clean while suspending the rules and adding several anti-gun amendments to HB80. Any changes to HB80 at this point would likely kill it in the house and all it needs to pass at this point is a simple concurrence vote.

Kim Stolfer (Firearm Owners Against Crime) and several other groups are in Harrisburg at this very second in an effort to stop these people, but they need your support. Everyone needs to call their representative AND the following members of the rules committee:

Tell them you want HB80 to be passed out of committee with no amendments and HB1750 killed or the language that bans pigeon shoots (and certain types of dog training) removed.

This is the last chance to get this through. If these anti-gun groups succeed today we are probably dead in the water.
