HK 416 on Gunbroker... How?

I was on gunbroker a second ago and found this:

I thought the HK 416 uppers were not available for civilian sale yet? Pretty pricey at over 5,000 so it would be a poor investment if HK does come through with their promises of a civilian 416. Anyway is this auction for real or is it some bloke trying to rip off and unsuspecting HK fanboy? If it is for real... how did it end up for sale to the general populace, pending NFA paperwork since its a 10.5 barrel?
 
It's my understanding that a very tiny few came into the US market a while back. If I remember correctly, HK didn't intend to sell them to civilians at the time, and put a stop to their "mistake."

Remember... even if they do sell them, you'll still suck, and they'll still hate you.

Of course that will never die. I still get a couple hundred hits every day to that on my blog. :)

I just got some behind the scenes info with the testing of the 416. The damn thing gets HOT! Notice that on all the testing videos, they keep dunking it in water? Yep. There's a reason for that, and it isn't to show how reliable it is when you dunk it in water.

Temperature at the handguards after 3 mags in 90 seconds ('cause we know that never happens in real life) is about 700 degrees.
