I don't really get this event. The guy was out 30 days later to go to a meeting at an FBI office or something, and I guess it makes little sense to me.

If you are terrorizing or criminal threatening enough to get taken down by an off duty officer, how is that a misdemeanor? If all he did was a misdemeanor, quite possible the cop is guilty of assult for taking the guy down to the ground. Do you get tackled to the ground and disarmed for a misdemeanor?

I wasn't there, am not an expert on any of this by any means for sure, but - none of these stories ever seem to make any sense. Did anyone question the guy about why he was at a mall with a rifle outside a kids dance recital? or they just let him go becuase he was not doing much of anything and threatened to sue?
 
Charging a criminal offense is based on what you can prove beyond a reasonable doubt. He was most certainly questioned about what he was up to but he has rights and is under no obligation to answer any questions and likely did not. He will not sue because if he does he will have to explain his reasoning for bringing those weapons and ammo into the mall and why the officer was in the wrong for suspicioning him nd taking him down. It would be a civil case and he has no right to remain silent then.
