In this case, the issue is a change in the Code of Federal Regulations on how a government Bureau (BATFE) directs enforcement of 18 USC 922 not in the general, but in the very specific. BATFE alleges the Law, as legislated, allows this definition, and not only that, but this change in direction, to create a new line of enforcement. (These are among the Comments that I made, that BATFE identify where in 18USC922 the ability to randomly select gun parts for regulation as firearms was defined.)

Do you have any link to this or is it just more internet speculation? The brace fiasco has been going on for a while.

It sounds like the frames and receiver rule is likely to come out in April 2022 and there is still speculation as to whether the brace rule will also be fast-tracked. This is where I received the information. Hopefully, the originally-reported summer release for both of these rules is the earliest that they will come out, but time will tell.

I read, and re-read, and read again the proposed regs before commenting on them. Beside the fact that the evaluation criteria is wildly ambiguous, there was one item that was crystal clear, assuming that what is adopted is the same as proposed.

If a short barrel weapon was originally sold with a brace, and if that brace fails evaluation, then ATF considers that weapon to have always been an SBR. As such, you can't claim the "it was a pistol, then I put a brace on it, so now by removing the brace it is a pistol again" defense. Since it was considered to an SBR, a rifle, to begin with, you can't go back to pistol configuration. As a result, you cannot just remove the brace to become righteous again. You will need to either a) pay for a tax stamp, or b) put a longer barrel on it, or c) destroy it (or d) run the risk of having an unregistered SBR).

If you had a pistol, and after originally configuring it as such, you will be able to go back to pistol configuration by removing the brace. However, if you purchased it with the brace already installed, then you cannot make it a pistol again.

I objected to your first post because calling the President denigrating names is a political act, pure and simple, and my understanding is that this forum is not for politics. I think your post should be deleted as it serves no purpose in this thread, which is about a technical issue regarding pistols and short barreled rifles.

I asked about your second post because what you said and what you seemed to mean seemed almost diametrically opposed. Apparently it makes sense to you, which tells me what I wanted to know, I guess. As a bonus, I learned that you don't know what "berate" or "semantics" mean. On the other hand, if you really do feel berated, that is a much better example of whining than anything I said.

Finally, regarding the events of 6/1/2021, I forgot that people like you need to trivialize it and hope the world has moved on from it. You may have done your best to move on, but many others have not. People who believe in democracy instead of kicking over the card table and fomenting a coup when they lose.

I am not the best writer obviously. Let me clarify. If the aTf says it’s now a sbr, I am not ok with that and filing out paperwork for something that I may or may not own. I wrote my Representative. Just remember the end game is confiscation. Don’t give them an inch.

I am sure they are out there, but I am sure most owners know they are contraband. Not many if any were turned in. Owners were supposed to destroy them.
The ATF and POTUS were asking to double the ATF budget to they could better enforce ATF rulings.

There is more to it. Once you have registered and SBR it is under ATF regulation. I live near the AL-FL border and if I want to use a shooting range in another state one must first do paper work with the ATF to transport the SBR to another state:

You cannot just take your SBR across state lines, you will need approval from the ATF first. Using the A Application to Transport NFA Firearms form you can request a duration of travel for up to one years time, which essentially equates to you being able to transport the firearm multiple times to the location.Aug 5, 2018

There is more to it. Once you have registered and SBR it is under ATF regulation. I live near the AL-FL border and if I want to use a shooting range in another state one must first do paper work with the ATF to transport the SBR to another state:

This is the reason I have not turned my pistol AR into a SBR. You have to fill out that transport paperwork. You can fill the paperwork out to cover you for months and multiple trips at a time but you still have to periodically update that filing. With an AR pistol, even with a suppressor on it I don't have to ask uncle same permission to got to another state with it.

I know the lawyers will explain how a restrictive regulation banning existing products is not an illegal ex post facto criminalization, but the effect on the ground is the same.

So I will not play word games with the regulators until they say I can't; or put an extra layer of registration on a gun.
