I keep hearing that Obama cannot use Executive Orders to accomplish certain things. What I do not think that most of you know, perhaps you do, is that after the BP spill Obama issued executive orders revoking permits and banning drilling. They were illegal, a court ruled them as so, but everyone complied and continued to comply (http://www.huffingtonpost.com/2010/06/22/obama-offshore-drilling-m_n_621229.html).

This President has made doing things illegal a specialty of his.

http://usgovinfo.about.com/od/usconstitution/a/attainder.htm

The Constitution of the United States, Article I, Section 9, paragraph 3 provides that: "No Bill of Attainder or ex post facto Law will be passed."

A bill of attainder is an executive or legislative death warrant, or punishment order. The only way that can happen in our system is through the courts, but that did not stop bin Laden, Alqui, and others from getting popped and put on a kill list (http://www.aclu.org/national-security/al-aulaqi-v-panetta). Laugh if you want, but we are a country that embodies the "if you can do this to the least of us, you can do it to me" principle.

Health care, the NDAA, bail outs, and on and on and on. Most of these are extremely questionable. That is what we have in office.

So yes, Obama can and will use executive orders and violate the Constitution if and when he decides to do it. The best predictor of future behavior is past behavior. Look at the sheer scope of what this President has done and then tell me what he can't / won't / shouldn't do.
