Judge: Victims of Chicago violence can proceed with lawsuit seeking tighter control of gun sales

    To the plaintiffs credit Chicago was a tranquil urban utopia pre-McDonald/Heller.

    What's the state going to do, take away guns altogether?

    I'm guessing we are just suing for money, not because we are community activists seeking tighter gun control. A greedy attorney exploiting ignorant city dwellers.

    Well, they could start by actually prosecuting straw purchasers and illegal possession by felons and drug dealers... .

    Or, he has, and it was not part of the narrow point of contention.

    If I read between the line right (no guarantees there) the contention ruled upon was whether citizens have a right to bring a suit against their State (whether the Executive branch or Legislative--that soup sandwich was under clear) seeking redress due to a presumed laxity in either the laws or their enforcement. Note that none of that considers RKBA.
    What this appears to be is that, a sufficiently concerned group could sue the Governor for not requiring, oh, say, stricter enforcement of speeding laws, in the name of a larger public good.

    Now, in this particular, specific instance, the party bringing suit is likely going to have to show one of tw things (depending upon who/whmo they mean t lean upon. Either the Legislature was knowingly lax in framing the laws (IIRC, Legislatures, by precedent, cannot be held to be negligent by ignorance or incompetence--but I could be remembering that all topsy-turvey). Alternately, their case might be that enforcement is, knowingly, too weak.

    That latter might be a fascinating case to be fly-on-the-wall to. Either for protestation that "my neighbor's go too many gunz!" or "youse ain' 'restin' enou crim'nals!" (There's a third option, that the Courts wil lbe accused of not giving out harsh enough sentences, but, it's hard to sue judges that way.) Either way it could be fascinating Kabuki.

    Like as not, it will vanish into the great maw which is civil actions versus governments and be as substantial as yesterday's clouds.

    Yep. Legally sold firearms are the problem. Got it.

    Anyway, I thought Chicago blamed Indiana for their "gun problem?" As if Indiana was awash in the blood of shooting victims.
