kitbashed handguns

I am asking about the legality or regulation of old handguns here. I found a decent condition s & w online, and have a question as to what it is legally considered to be.

The revolver is a tip up/ top break. The caliber is 38 smith and wesson, the barrel assembly of barrel, top frame, and cylinder and ejection system are pre 1898. The grip frame is post 1898 with a serial number under 300,000 . is this a curio and relic or something that cant be defined until the lawyers get ahold of it?

The frame is the firearm it is not an antique no matter how many ANTIQUE parts are on it. It is However a C&R as it is over 50 years old.

What does "kitbashed" mean? Is that brit or canadian slang? I'm not sure what your gun laws would be in your country.

When I was younger and into plastic model cars and such, the term was used to describe a model that was made of parts from 2 or more kits. So the gun would be made of parts from 2 or more firearms.

Definately a C&R [ older than 50 years ].

I believe the lower frame/grip assembly is considered the "reciever" for the firearm {*}, and hence, will not qualify as an 'antique' firearm as well.



* very similar to how the lower reciever on an AR-15 is "the firearm", and not the top portion of the reciever.

Serial Number

If there's any doubt which part of the gun is the "receiver" or "frame" for firearms purposes, wouldn't the part bearing the serial number be the "actual" gun?

Some guns have the serial number on various components. I've seen some modern pistols (SIG, maybe?) that have the same # on the frame, slide and barrel.

Thats the thing that confuses me, what part constitutes the reciever/firearm itself? The barrel/cylender assembly, or the part you actually put your hands on?

If it makes it any easier, the barrel half of the pistol was made pre 1898, but the actual handle half is post 1898/1900. And ironically the two halfs of the gun are different models of the same gun, ie a barrel from model "2" and a grip frame from a model "5". Makes one wonder if the lawyers thought about it.

General rule of thumb for C&R...

2007 - 50 = 1957

There are exceptions, be sure to check the "book" from the BATF/E.
