NRA Files Lawsuit Challenging ATF’s “Engaged in the Business” Rule
The National Rifle Association of America (NRA) has filed a lawsuit challenging the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) “Engaged in the Business” Final Rule. The ATF’s Final Rule unlawfully redefines when a person is “engaged in the business” of dealing in firearms and therefore required to be federally licensed. This new lawsuit is being filed on the heels of recent U.S. Supreme Court decisions that have reined in executive branch agencies from acting outside of statutory authority.
Third Circuit Affirms Denial of Preliminary Injunction in NRA-ILA-Supported Challenge to Delaware’s ban on “assault weapons” and “large-capacity magazines.”
On Monday, July 15, the Third Circuit Court of Appeals affirmed the district court’s denial of a preliminary injunction in Delaware State Sportsmen’s Association v. Delaware Department of Safety & Homeland Security, NRA-ILA’s lawsuit challenging Delaware’s ban on “assault weapons” and magazines that hold more than 17 rounds.

A New York judge has ruled that there will be no court-appointed overseer to monitor National Rifle Association, denying New York Attorney General Letitia James' request for further oversight of the organization.
Since President Joe Biden unceremoniously dropped out, or was forced out, of the 2024 presidential race on July 21, Vice President Kamala Harris has been effectively coronated as the Democratic presidential nominee.
On July 23, the Memphis, Tenn. City Council approved a series of ballot measures for the November election that purport to enact local gun control measures in the Home of the Blues by amending the city charter.
Politicians in anti-gun jurisdictions tend to favor a dysfunctional approach to public safety, whereby the softer targets – the law abiding –are burdened with new restrictions and potential liability, while the actual perpetrators of violent crime are held less or not at all accountable.
Yesterday, in Ortega v. Grisham, the U.S. District Court for the District of New Mexico denied the plaintiffs’ motion for a temporary restraining order and preliminary injunction against New Mexico’s law requiring individuals to wait 7 days before taking possession of any firearm they purchase.
While most Americans were still desperately trying to figure out how the failed assassination attempt on President Donald Trump (R) came so shockingly close to being successful, at least one rabidly anti-gun extremist in Congress saw an opportunity to try to exploit the situation to promote himself and his agenda to eradicate the Second Amendment.
This past weekend marks the completion of a series of “NRA 2A Day” events that were organized by the Ohio NRA-ILA Grassroots Team, and held throughout Northern Ohio, at all Fin Feather Fur Outfitters locations.

At the National Rifle Association's 2024 Annual Meetings & Exhibits, the NRA Board of Directors elected Doug Hamlin, then executive director of NRA Publications, to serve as the organization's new CEO and executive vice president following the resignation of Wayne LaPierre. Hamlin has tackled the job with enthusiasm and vigor and is moving ahead with initiatives that will renew the National Rifle Association and set it on the right track for the future. His new role comes after a lifetime of service and dedication, first as a United States Marine and then as a longtime presence in the firearm industry.
In its more than 150-year history, the National Rifle Association has become the world's largest and most effective advocacy organization for firearm owners. It has a widely recognizable brand and track record of Second Amendments success stories which makes it an essential part of the firearm community. Following his work as a Marine Corps recruiting officer, where he played an important role in officer selection, Hamlin set his sights on the firearm industry. Hamlin eventually moved up to work as the publisher of MotorTrend, the flagship publication of the Petersen Publishing Company. With the Internet taking off in the 1990s, Hamlin embraced the digital age and founded autoMedia Solutions, a private company dedicated to providing up-to-date automotive news and information to modern consumers.
"I'm a Midwesterner at heart. I'm from the great state of Michigan," NRA CEO & EVP Doug Hamlin said. "At a young age, I had high hopes to be a U.S. Marine, and I was fortunate to get that opportunity. I served on active duty for six years as an infantry officer, and I also was on recruiting duty. At that time, I was introduced to the Petersen Publishing Company through friends who were working for the company in Michigan, and since I was based in Los Angeles, I was able to apply there and ended up going to work for Guns & Ammo magazine in the late '80s and had a wonderful 14-year run there. Ultimately, though, I was recruited to come to the National Rifle Association in 2014 as the executive director of Publications, and that has clearly been the highlight of my career up to this point."
As a divisional director at the National Rifle Association, Hamlin has worked with other leaders and staffers within the organization, giving him a keen familiarity with all elements of the NRA. Additionally, he recognizes the unique place the organization has within our country.
"The NRA has honorable history going back to 1871. We've had nine U.S. presidents as members," Hamlin said. "We've had Medal of Honor recipients as presidents of the organization. We continue to celebrate, culturally, our heritage. The return on the investment the members have made in the NRA is undeniable. The clout that we have on Capitol Hill, it comes from our membership. The NRA Institute for Legislative Action is the gold standard in political lobbying in Washington. They win."
Today, Hamlin has one goal: To grow the National Rifle Association. The strength of the NRA has always been in its members, and with an increasing membership, plus increased participation from existing members, the organization will be an even more powerful advocate for the rights of firearm owners nationwide.

We talked last week about one of the problems newly-minted VP candidate Tim Walz (D) had been facing. Whether it is considered “stolen valor” for Walz to have implied he served in an active combat zone when he did not is a hotly debated topic these days. Our problem with Walz, though, is the idea that he is any sort of an expert to be listened to when determining what firearms the government should prohibit law-abiding citizens from owning.

The legacy media has mostly given up the pretense of carrying out its once-professed mission – holding power to account. At this point, no reasonable person expects the regime press to cover legitimate news that might reflect poorly on their political allies. Still, conspicuous ignorance is one thing, distortion is another.

Americans are deeply divided on many issues these days. But a recent poll conducted by Marquette University Law School in Milwaukee, WI, revealed at least one area of broad agreement: A supermajority in the U.S. supports a right to carry firearms in public for self-defense. The poll questioned 1,005 adults nationwide from July 24 to Aug. 1, 2024, and has a margin of error of +/- 4 percentage points.

On August 16, the NRA and the Second Amendment Foundation filed an amicus brief supporting a challenge to Massachusetts’s carry restrictions for nonresidents. The brief argues that Massachusetts’s nonresident licensing scheme violates the Second Amendment because it is overly burdensome and unsupported by a historical tradition of regulation. Throughout American history, nonresidents were never subject to greater restrictions than residents. When nonresidents were treated differently, it was always to provide them greater carry protections. But Massachusetts’s licensing regime is significantly more burdensome for nonresidents than residents, often requiring multiple trips to the Commonwealth—in addition to other burdensome requirements—to acquire a nonresident carry license that is valid for only one year.


We previously reported to you on the announcement of a new policy banning License To Carry holders from possessing firearms at the Texas State Fair, property which is owned by the City of Dallas but contracted out to a nonprofit entity (the State Fair of Texas) to run the annual event in the fall. Today, Texas State Attorney General Ken Paxton sent a letter to the city, directing it to end this policy, which violates state law prohibiting restrictions on the carrying of firearms on property owned or leased by a governmental entity unless those premises are specifically enumerated as prohibited locations under Texas Penal Code Section 46.03 (note that the Texas State Fair does not meet the criteria for an "amusement park", which is one of the prohibited locations in 46.03.) Paxton also warned the city that unless the wrongful exclusion of LTC holders is corrected within 15 days, he will file suit to seek injunctive relief and civil penalties under Texas Government Code Section 411.209. NRA-ILA thanks General Paxton for taking swift and decisive action to enforce state law and protect the Second Amendment rights of law-abiding Texans!


Yesterday, NRA joined an amicus brief filed in the U.S. Supreme Court in Lackey v. Stinnie to prevent governments that violate constitutional rights from avoiding attorney fee awards by strategically mooting a case before final judgment.

Last week, the Biden-Harris administration celebrated the one-year anniversary of the White House Office of Gun Violence Prevention.
Kamala Harris is the most anti-gun candidate who has ever been as close as she is to becoming president, even if she has been less than forthcoming on her specific views on firearms and the Second Amendment.
Vice President and Democrat presidential candidate Kamala Harris has, in the past, been forthcoming about her support of gun confiscation and mandatory “buybacks” (here and here), and there’s little reason to believe that she has changed her values.
On September 24, NRA and the Firearms Policy Coalition filed an amicus brief in United States v. Duarte, a challenge to the federal lifetime prohibition on firearms possession by nonviolent felons.
On September 24, NRA filed an amicus brief supporting a challenge to the federal ban on carrying firearms at post offices.
This Executive Order is just one more attempt by the Biden-Harris Administration to deflect attention from their soft-on-crime policies that have emboldened criminals in our country. The orders are notably heavy on election-year rhetoric and light on substance. It's no secret that Americans don't feel safe under the Biden-Harris Administration, as evidenced by the record number of firearms being purchased for the defense of self and family.

NRA-ILA routinely points out that it is more informative to watch anti-gun politicians and officials’ behavior than to listen to the platitudes they spew about enacting gun control to protect the public.
On December 5, at a late afternoon press conference in Ottawa, Canada’s federal Public Safety Minister Dominic LeBlanc announced that 324 additional makes and variants of rifles would be added to the 2020 list of over 1,500 so-called “assault-style firearms,” being semiautomatic guns that Liberal Prime Minister Justin Trudeau and his officials had dramatically and disingenuously described as “military grade assault weapons.”
The plague of businesses and even individuals being exiled from the modern economy by politically motivated regulators is back in the news, thanks largely to a recent segment on the Joe Rogan Experience podcast in which a guest highlighted the ongoing scandal.
Philadelphia and Pittsburgh have been trying, and failing, to circumvent Pennsylvania’s firearm preemption law, first enacted in 1974, for decades.

Dear NRA Member: U.S. Representative Richard Hudson (R-NC) has reintroduced the Constitutional Concealed Carry Reciprocity Act (H.R. 38). Representative Hudson, the longstanding champion of this legislation, along with more than 120 of his colleagues have sponsored this bipartisan bill to provide nationwide reciprocity for concealed carry license holders and residents of Constitutional Carry states.
On Friday, Gun Owners of America published an email reportedly received by one of its members in response to a question to ATF about whether adding a brace to a CZ Scorpion pistol would convert the gun into a short barreled rifle for purposes of the National Firearms Act (NFA).
Last Monday, the U.S. Court of Appeals for the Fifth Circuit – which encompasses Louisiana, Mississippi, and Texas – reversed the conviction of a man under a federal law that prohibits firearm possession by one who is “an unlawful user of or addicted to any controlled substance{.]
In the 2008 District of Columbia v. Heller U.S. Supreme Court decision, Justice Antonin Scalia contemplated potential location restrictions governments could impose on the exercise of Second Amendment rights.
