Multiple Sheriff's send letters - No intent to enforce

Tim Mueller, Linn County Sheriff of Oregon has written a letter to Vice President Joe Biden. Any new gun legislation passed by EO or otherwise he refuses to enforce, or to allow any federal officer to enforce them in his county.

Dear Mr. Vice President

I am Sheriff Tim Muelle, elected twice by the citizens of Linn County, Oregon who have entrusted me
with a noble cause: to keep them and their families safe. My deputies and I take that responsibility very
seriously and like you, have sworn to support the Constitution of the United States. I take that oath
equally as serious as protecting our citizens. I have worked for the people of Linn County for over 28
years as a member of the Linn County Sheriff's Office as well as serving three years active duty as a
Military Police Office in the US Army, where I also swore a similar oath.

In the wake of the recent criminal events, politicians are attempting to exploit the deaths of innocent
victims by advocating for laws that would prevent honest, law abiding Americans from possessing certain
firearms and ammunition magazines. We are Americans. We must not allow, nor shall we tolerate, the
actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will
infringe upon the liberties of responsible citizens who have broken no laws.

Any federal regulation enacted by Congress or by executive order of the President offending the
constitutional rights of my citizens shall not be enforced by me or by my deputies, nor will I permit the
enforcement of any unconstitutional regulations or orders by federal officers within the borders on Linn County Oregon

In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens
are turned into criminals due to the unconstitutional actions of misguided politicians.

Dear Mr. President,

My name is Charles M. Heiss and I am the Sheriff of Johnson County, Missouri. I have held this office since January 1, 1997. I am writing to you to express my concern with the tone of your administration with respect to the Second Amendment Rights of American citizens. It appears to me and many Americans that there is a genuine desire on the part of your administration to restrict the Second Amendment rights of law abiding American citizens in the interest of curbing gun violence in our nation.

Throughout our nations history the United States Constitution and the Bill of Rights has served as the very foundation of our free society. The Second Amendment to the United States Constitution has long guaranteed our citizens the right to keep and bear arms and is central to our ability to live in a free society. Any attempt to restrict these Second Amendment rights through executive order is unconstitutional and tantamount to an all out assault on the United States Constitution. Just as the Fourth Amendment to the constitution guarantees our citizens the right to be secure in their persons, houses, papers, and effects against unreasonable search and seizure, the Second Amendment guarantees each of us the right to keep and bear arms to protect ourselves from anyone who would seek to cause us harm. This includes the federal Government.
World history has shown us that when a society does not possess the ability to defend itself it becomes ripe for victimization by criminals, and ripe for government oppression. One need not look too far in today’s world to see glaring examples of defenseless people being brutalized by rogue regimes and dictators. Syria, North Korea, and Mali are just a few examples of this type of oppression. Mexico is a stark reminder of a society overrun with criminal element in the form of Drug Cartels.

As the duly elected Sheriff of Johnson County, Missouri, it is my sworn duty to protect and defend the Constitutions of the United States of America, and the State of Missouri against all enemies both foreign and domestic. This means I not only have the duty to protect my constituents from incidents of crime, but I also have a duty and responsibility to protect and preserve the individual rights and liberties afforded and guaranteed to every citizen by our constitutions. This, Mr. President is a duty I fully understand, appreciate, and will carry out with great vigor and conviction. I will most certainly urge my fellow Sheriffs in the State of Missouri and across this great nation to rise to the defense and aid of all Americans should the federal government attempt to enact any legislation, or executive order that impedes, erodes, or otherwise diminishes their constitutional right to keep and bear arms. I will use all means legal to meet this solemn and sacred responsibility.

I admire the sheriff's initiative, but it will change when all federal funding in his county dries up.
 
I don't see any thing but bad coming from all of this. I feel for the officers who are told they will have to enforce laws like this. I hope they have the good sense to resign their positions instead of going against the constitution.

I know that Sheriff Richard Mack was giving talks in the Pac NW, I wonder
if he made it to Linn County Oregon.

This is the last hope, in New York and anywhere else that imposes such draconian laws; that the police will refuse to enforce these laws.

I don't see that happening in New York though...

While I appreciate his and other's stances - I have yet to have gotten sideways with a Sheriff's dept in relation to firearms regulation.

Always been municipal, state or federal.

But I am diggin' these Sheriffs. Too bad Maricopa's won't stand up. I figure his shoe-in won't be so certain next time around for it!

When you're one of us who lives outside of town limits, the county sheriff is who you'll deal with. If a town cop showed up at my place acting officially, I'd laugh at him and tell him to pound sand.
 
Too true. I've been buttonholed a couple times (always in the right so far) outside the usual jurisdictions - in fact our shop is currently in a county annex surrounded by three municipalities - yet the Sheriff's Office still leaves us be and anyone we have dealt with has been state or federal.

I was discussing the topic of states refusing to implement federal laws or EU's with a friend recently. Is there any credibility to using the Mack Vs. US case on this issue?

...not to say that the state and its citizens couldn't still play the bully game both ways and make it virtually impossible for the federal gov't to enforce gun laws by refusing local aid, even if the federal gov't seems to think it can override state sovereignty. Sheriffs also retain the right to refuse to enforce federal gun laws (Mack vs. US). "You instituted the law, you enforce it by yourself and we're not helping" vs. "we're going to prosecute if you enforce this." Such a distinction might allow the states to avoid federal legal action and having their funding dangled in front of them. Of course, maybe it's time for the states to be bold and say "screw the federal gov'ts reaction, we're going to assert our sovereignty no matter the consequence". The more states that adopt either sentiment into law the better imo. Even though in the short term some of the laws might be doomed in court, it still sends a message to the federal gov't that it will be totally on its own if it tries to circumvent the 2A...
 
A Texas representative is trying to push a law through similar to this:


A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.

Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.

"If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution," Toth told 1200 WOAI's Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison.

I applaud sheriff Mueller’s brave stance, regarding his decision to have his deputies enforce or not enforce any pending legislation. I do have two problems with his decision; Sheriff Mueller took an oath to uphold the law, not just the laws he approves of. Second sheriff Mueller may be in for quite an unpleasant surprise if he actively attempts to stop or obstruct any Federal law enforcement officer who is acting under color of law.

Please folks try and remember the last 4 + weeks have been some of the most trying and disturbing times I can remember in years. I read and heard normal and sane people say some of the most outlandish things. If there is one time we have to take the “high road” and present ourselves as calm cool sane and rational adults this is it.
 
I'm going to be contacting my Sheriff about this. I live in Marion County, adjacent to Linn. It'll be interesting what he says.
