I'm moving into a house on 20 acres in the middle of the Lee Calf Wilderness (It's near Bear Trap Canyon). I will be renting this place until my permanent residence is built (which will be on 160 acres) Anyway, the rental has no HOA. No town for 18 miles. Nearest neighbors are on the other side of a 3500 foot mountain. Nearest road is about 6 miles (2 miles as the crow flies). I've searched Montana legislature until my eyes bleed, but can't find any definitive rule. Is it legally ok to shoot on my property?

I don't want to move in, start shooting and have LEO walk up and cuff me.

Thoughts please!

You need to relax ;)

I have 40 acres and have killed 2 deer on my place. One of them from the deck, the other from the edge of the mowed lawn.

I have a little shooting range out back - mostly just tin cans on tree stumps.

One warning though: once you live here a while and get used to freedom, you will never want to live anywhere else again.

hahaha, so you can tell I've lived in CA for too long eh? :)

I'm very excited about the move and the "new" freedoms, just have several years of CA Nazism influenced laws that make me question every move.

Thank you for your responses, I will be setting up a little range in the near future :D :D :D

BTW, in doing some research about Montana's view on gun control, or lack thereof. So far, i'm quite impressed. Especially with the 77 vs 2 responses to MSU's proposed policy change.

I am wondering about that ammo plant your trying out where and when?
I hope your a GRIZ fan see you at the games!!

It's Stevensville and I'd still be there except some idiot decided to build his house within 100 feet of my place way out in the country.

Forgot to mention; it's the Lee Metcalf Wildlife preserve and the other reason we moved was because Montana has the highest state income tax in the country.

Hi BRIGHAMR, I moved to Montana 4 years ago also from CA (San Diego CO). CDRT is right about the state income tax. It is very high, but we have no sales tax. You will like the gun laws after living in CA. After you get your MT drivers license you can go to a gun store buy a pistol and a box of ammo and walk out with it in maybe as little as 10 minutes, if you don’t drool on it too long before paying for it. You will have to fill out the papers and they will call it in and get the OK within two to three minutes. Now the good part. You take the pistol and ammo out to your truck (you do drive a truck don’t you) you fill the pistol up with all the ammo it will hold and put it under the seat, or anywhere else in the truck you want too and drive home. Shoot up all the ammo in a safe direction and YOU HAVE NOT BROKEN ANY LAWS. Also if you are outside of the city limits of any town and watch out for a few off limits places you can put that pistol under your coat or down you pants or whatever, walk around and you still have not broken any laws. After you have lived in the state of six months a CWP is just a trip to the sheriffs office, pick up and fill out the papers. It depends on what county you live in as to how long it will be before they call you in to pick up your CWP. 60 days is the state max. All of this of course depends on you having a clean record ect. Email me and let me know where you will be, if it is not too far, maybe we can get together.

Willis - you make a good argument there. ALso sounds suspiciously like your taxes are getting you a return on investment in terms of freedoms.

No lie about taxes, and you don't get much for them. The again, we have 800,000 people in the fourth largest state, so I'm betting it mostly goes to roads. We have voluteer firefighters. Same day service.

I finally got off my butt and got my CCW. I've been here two years, and had a permit in Oregon. Just never found a place where I felt the need to carry. One murder last year in the city. BTW, it took a whole week to get the CCW, including time in the mail.

I live in Helena - East valley. It's a semi suburbia kind of place, with lots of about 1.5 to 3 acres. Last week I shot a rabbit in my backyard with a 22 revolver. The neighbors didn't seem to mind, althou one did comment about 'rabbit for dinner' while my daughter and her friends skinned and gutted it on the back porch.

It's a very different place (I moved from Portland OR)

Move to Wyoming or South Dakota... no state income tax there.

It must be nice to shoot off your back porch... maybe one day <sigh>.

The only thing to be wary of is catching something on fire. Thats about the only rule out here. :D

Out in the country it is fair game. I live in town next to the Missoula airport so I might get some unwelcome attention if I shot from my porch....

police putting the cuffs on someone for violation of gun law... in montana? That's new to me. I don't live there, but I hear that the police are more in the cities and it's one of the few states left where you can shoot someone for trying to take over your claim.

then again, I don't know a lot of fellas mining platinum with just a pan and a stream...but that's just me.

I also hear that the roads are paved with real gold. is that true?

Ours are paved with "gumbo"

Nice and dusty when it's dry, and turns into grease when it's wet. Sticks to your tires and the underside of your fenders and wherever else it touches. I've heard tales of tires getting so balled up with the stuff that they couldn't turn anymore. When you walk in it, you don't make footprints - you carry your footprints with you :D

Whats land go for out in Montana? You just got me interested in a retirement plan lol.

It is paradise, i plan on moving there eventually, land is plenty and sometimes dirt cheap. i recently researched 6700 acres with a 5 bed house for $850,000 ..once i can afford something like that, im outta here.

No.. it sucks. Everyone stay out

At least until I can afford my own place in the country, then all you yahoos can come and drive land prices up again! :)

When I read the title of the original post I thought, "What a silly question", until I remembered about the restrictions in other parts of the country. The restrictions other states impose sometimes totally amazes me. The only thing that concerns me about shooting off the back deck of my house is that the Savage .17 HMR I bought spring of last year was too dang effective on the gophers (ground squirrels). I didn't find nary a one to shoot this year!

After you have been here a bit get a CWP as well as suggested above. You only actually need one when in town but there are other benefits. No NICS check for one thing. It also covers anything else that would be considered a concealed weapon, not just a handgun. "Concealed" in Montana means "concealed by a piece of clothing". Carry a gun in a paper bag and it's not concealed. Carry a loaded handgun in your glove box and it's not concealed.

I do ask one favor. If you talk good things about Montana just make sure it's to pro-gun people. If you talk Montana to antis make sure you scare the panties off them 'bout all the gun totin' varmits out here.

Oh, anybody out there wanting to visit/move to Montana, remember the rules as printed in a local magazine: "Outside Bozeman"

Rules for Entering Montana

1. Pull up your droopy pants. You look like an idiot.

2. Let's get this straight; it's called a "gravel road." No matter how slowly you drive, you're going to get dust on your Lexus. Drive it or get out of the way.

3. They are horses, cattle, saw mills, and oil wells. That's what they smell like to you. They smell like jobs and a fine way of life to us. Get over it. Don't like it? I-90 and I-94 go east and west; I-15 goes north and south. Pick one.

4. So you have a $60,000-dollar car. We're impressed. We have quarter-million-dollar, air-conditioned tractors that we drive three weeks a year.

5. So every person, in every pickup truck, waves. It's called being friendly, try to understand the concept.

6. If that cell phone rings while a flock of geese is coming in, we will shoot it out of your hand. You better hope you don't have it held up to your ear.

7. Yeah, we eat geese, trout, deer, elk, and antelope. You think it tastes “gamey”? Order some rice cakes off the internet.

8. The "Opener" refers to the first day of big-game season. It's a religious holiday, held the next-to-last Sunday in October.

9. In Montana, it is not trendy and is considered very, very unsafe to criticize the USA. God bless John Wayne, Elvis Presley, Audey Murphy, Cary Grant, Charlton Heston, and Jimmy Stewart; but the rest of Hollywood is not welcome here.

10. No, there is not a "vegetarian special" on the menu. Eat steak or you can order the Chef's Salad and pick off the two pounds of ham and turkey.

11. When we fill out a table, there are three main dishes: meats, potatoes, and breads. We use three spices: salt, pepper, and Alpine Touch.

12. If your dog weighs less than the average rabbit, do not be surprised if we shoot it. We can’t be expected to recognize such subtle distinctions. Get a real dog and you’ll have nothing to worry about.

13. P.S. Grizzlies are eagerly encouraged to eat out-of-staters.

living in missoula i know first hand about that.
the prices of appartments here are getting to high to be able to afford, land is unthinkable, everything and i mean everything around here is getting turned into sub divisions
