I’m moving my machinegun to another State. This will be a permanent move and I need to know what form I need and can I get it online?

Also, how long does it take from the time you send it in to when they approve it?

    Thanks….. Frankie

    ATF F 5320.20

Needs to be sent in prior to the move/transport.

Not sure what the time frame is anymore.

Before timelines got crazy 5320.20's took 30 days, so figure 60 days minimum now.

Quiet & Bubbles - Thank you for your responses. I downloaded a copy of the form and I'm going to fill it out.

Since they want a time-line for the machinegun's travel, would you suggest that I contact them about a date of their approval?

I think I'd want to know the restrictions that might apply in the state you are moving to. Be a bad idea to start out breaking state or local laws there without knowing what to expect.

Like Sharps said, there are still a few states that won't allow NFA goodies. I recently moved into Iowa and found out that I had to leave my almost new silencer behind :( (stored properly per ATF instructions).

BATFE won't approve moving the gun if the new state does not allow possession (that is the reason for the notification - a simple change of address within a state requires only a letter). But also make sure the new state does not require registration or some other state/local process.

SharpsDressedMan & Darkbob - I checked online, but just to be sure I paid a visit to the local sheriff and he said it was okay to possess it as long as I was the legal owner and that I didn't commit any crime that would bar my having it after I initially got the machinegun.

Jim K - The sheriff did not indicate to me that there was any other process other than approval by the BATFE, however I did not specifically ask that question. I'll make another trip back to verify that Thanks for the heads up.

SharpsDressedMan - Mississippi for now, but I have a really serious job offer coming up next May in Florida.

I asked about local laws because some states, like MD, require that MGs brought into the state be registered within (I think) 5 days. BATFE will approve the move, since MGs are legal in MD, but probably won't mention the registration because it is not a federal thing.
