My boss, (who I cannot stand) was turned down here in Texas for a handgun purchase. My question is: what would he have to have in his background to do this? I'm assuming felonies only, & no misdemeanors.......

Was he permanently denied or only temporarily??? Could be a mistake or just lack of info at time of purchase..Just a delay of purchase while background is checked...

There are ton of misdemeanors that can result in a NICS denial (anything that carries more than 2 years in jail as a POSSIBLE sentence). Unpaid parking tickets or child support can also do the trick. Could just be a case of mistaken identity too..

IANAL but IIRC the highest possible sentence for a misdemeanor is 1 year in jail and the lowest for a felony is 1 year.

The definition of "felony" and "misdemeanor" varies from one state to another. Some states have "misdemeanors" that potentially come with 5 (!) years in the klink.

The "could be sentenced to more than a year" is the yardstick used by the feds.

Some states, like NJ, don't even have statutorily defined misdemeanors and felonies. Instead, they have crimes of the 1st through 5th degree, with 1 being worse than 5...I think....

i remember a friends father telling us as kids. boys if you mind your own buisness you'll be busy the rest of your life

In Ohio even a misdemeanor DV bars you for life for gun purchase or CHL. Ohio also doesn't base its approvals based solely on the NCIS. They send out letters to every county you ever resided. Ohio also has a 45 day limit to issue CHL but are very quick to pull once the response comes back negative.
