Just found out yesterday (I missed the article in the paper) that my creepy neighbor plea-bargained on federal pornography charges. He is only supposed to get only 30 months (instead of 20 years) and doesn't even get officially sentenced until June 8. He will still be loose until then.

This isn't one of those "puritan" type things (I am pretty "open minded"), but the stuff he was selling was apparently real hardcore and brutal. I'm not sure if the videos were acted or were tapes of actual crimes.

I'm not sure why the govt would accept this plea since they probably have already incurred most of the expense of prosecution and it appears they had more than a solid case against him, except that he is supposed to testify against someone else yet more involved in the making and selling of this stuff.

I suppose though that it is better for the court and the innocent jurors not to have to look at all that stuff in order to reach a verdict.

They also may fine him up to $250,000. I don't know if that means that he will have to sell his place or not. If not, I don't like to think about who he might be letting live there while in prison :barf:

Anyway, this means we have to stay on high security alert, at least until June 8. But at least the daylight is getting longer. I have plastered both sides of his easement through our land with "no trespassing" signs :p

Also, we have been doing fuel reduction for wildfire protection purposes, but it also clears out a lot of hiding places near the house.

Don't know if you did this yet, but those motion sensor lights are pretty effective, you might want to put those up.

Have curtains or blinds on the windows?

Stay sharp and stay safe!

I didn't see the original post, but if he was just selling it, that doesn't make him a super bad guy. I mean, is Walgreens bad for selling cigarettes? If you can make money off of other people being stupid, or wanting something stupid, then more power to ya.

But, like I said, I didn't see the original post. And you know him better than I do to pass judgement.

iiibdsiil:

The original thread from last Dec was entitled "Possible Abduction Attempt" and is probably buried several pages down now. In brief, we apparently had someone hiding behind our haystack when my daughter went out to feed her horses way before daylight one morning. Her dog alerted her and she ran back to the house, and a few moments later a car started up on the neighbor's driveway down the hill and raced out to the county road. My other daughter then reported that she had seen a car idling down there in the morning at least once before.

The neighbor has "guests" from time to time who are known sex offenders. Both I and another neighbor have had to run these people off our property in the past (usually they were riding ATVs on our land).

Since Dec, I have been getting up before everyone else and going out and checking the yard every morning. Also, going out with the girls anytime they are outside after dark, and sometimes during the day. Doors are always supposed to be locked, and if I find one unlocked I immediately start looking for everyone.

I have to assume that anyone who would market something like that (or any of his guests) might also be a sexual predator. Anyway, I'm not going to let something happen to one of my girls on MY watch.

Tallpine,

That's scary. That guy and his friends/customers are threats. I wouldn't let my kids go out at all without close supervision, either.

It's too bad he can't be imprisoned for life. He deserves it.

The feds don't tend to get involved in pornography cases where the issue is how much T&A is too much. That's an area left largely to the states. The feds, instead, focus largely on child pornography and cases where one party is unwilling. So, the question becomes whether selling pictures of men raping children the same as selling "cigarettes" in your world view.

News excerpt, FYI:

During Friday's hearing, the judge and attorneys avoided discussing the details of the crime. [Judge] Cebull asked defense attorney Mark Errebo if he and Lambert had read the government's offer of proof, which contained graphic descriptions of what the videotapes showed.

Errebo said they had but said he didn't want to go into the details.

"I'm with you, Mr. Errebo, on not going into the details.'' Cebull said.

The judge also made the document part of the record for further reference "for reasons I think are obvious to all of us.''

U.S. Attorney Bill Mercer said that from October 1998 to December 2002, Lambert and Wasserman conspired to distribute obscene videotapes using interstate commerce and common carriers. The videotapes, with titles like "Anything Goes'' and "Rape and Sodomize,'' depicted violent gang rapes of women, bestiality and sadistic and masochistic conduct, Mercer said.

When this :cuss: does finally make it into prison, it's more than likely what he did will leak out. While not model citzens, generally, those behind bars are not, well, nice ;) to folks incarcerated for sexually related crimes. Many end up being the victims themselves. :p One can only hope that this :cuss: encounters similar situations. ;) :D
In the mean time, keep your gaurd up in a non-chalant way and make sure all you do is 100% legal. Hope you and your family stay safe!
May also want to keep an eye on continued activity at his residence perhaps more of his cronies will go away if activity keeps up there it may be enough to get an "evidence seizure". Take care!

Tallpine;
I'm sorry for your ordeal. I went through a similar thing with my neighbor. It may take years to go all the way through the court system. If the states evidence convictions go through he will be freed sooner than you think.
The big problem is that I never knew what kind of coke snorting weirdos were going to be hanging around when I got home. The house has been vacant for two and a half years. His friends no longer visit. He is free but only comes to look at the house about once a week.

You could always allow local church groups to organize anti-pornograpy sit-ins or demonstrations on your prperty and allow the local media to come witness to raise the awerness of people in your community to where this scumbag lives and the types of things he does. He might think twice about where he lives if he knows everyone in his community hates his guts and wants him gone.

Not to drag this thread OT, but

Man, I should have known that pax would present some more info on the whole 3-7-77 deal.

From living in Montana for awhile I thought the numberss did come from the vigilantes, but I was wrong on that too. (and the publick school systems)

Thank you pax for providing the link to educate me on this bit of information.

Would be nice to leave one of those notes on some of the undesirable in the community wouldn't it?

Well, the "good" thing about all of this is that my twin daughters will both be leaving home in June, and it will just be ma and me at home. And hopefully, they have learned a thing or two from all this about being careful where-ever they are (especially Walmart parking lots).

BlkHawk73: yeah, I have thought the same thing about Lambert doing even a short stay in prison. Especially if he starts out doing his bitchy, whiney, busybody stuff in jail  You would think that somebody doing illicit stuff would at least try to get along with his neighbors and not PO them at every opportunity.

I have a couple other options ... I need to check with a MT attorney first, but if I spent the money to fence my place, I think that I can legally put gates on both ends of his driveway and require anyone going in or out to open and close both gates each time (of course, they would be two of the tightest stretch gates in MT  ).

The ponies are supposed to go to a new home after the girls leave, but if we decided to get a couple riding horses, I'm thinking about building a corral down on a flat spot just inside my property line from his house :p (It's not my dang fault he built his house right in the corner of his 40)

SIdearms at all times seems prudent. I'd personally pray for a lightning strike to set the pervs house on fire.

When you talk to the attorney, ask if the "neighbor" qualifies for the sex offender registry. Having your name on the list creates all sorts of restrictions (varies by specific state) on what you can & cannot do even on your own property.

I'm not much in favor of picketing & such-like just because a person's name in on the registry, but having them know you know may be just enough to make them think twice before doing something foolish. I know - chances are slim for most criminals, but this induhvidual may actually have functioning brain cells.

In ny case, remember that it was not so much your "neighbor" but his "guests" that made your radar screens light up. May be time to talk with the young ladies about knowledge of who one associates with as being an indicator of what one is like. Kids at college -- that's where they are hewading, no? -- are too green and trusting for the most part. Thank goodness somebody or something (insert your own flavor here) watches over most of them.

stay safe.

Sounds like you're being pro-active and cautious. That is good. Some general thoughts that may have occured to you already.

What you have is an infestation of cockroaches. Now society doesn't allow you to tent the house and gas them all, so you must keep them at bay and in fear of the bottom of your shoe. Cockroaches don't like the light and these pukes don't like attention. It is an investment in the future to make it clear to them that anything that happens on or around your property is going to happen with the full light of day shining upon it. This is done mostly by frequent sightings of you watching them. They may object and attempt to intimidate you but stay within the law and hold your ground.

Keep a log of their comings and goings. You are probably going to see patterns and then can have several social gatherings of your friends and neighbors at those times. I would keep descriptions of individuals as well as license plates. Don't be foolish but don't be too discrete either. Remember, you want them to know you are watching.

Get the neighbors involved, easier said than done especially since it sounds like they aren't right next door. It helps if the pukes know you aren't alone.

Call the cops alot. Every time there is a concern. The squeaky wheel gets the grease. I had a similar problem with a neighbor and the trash that they attracted and although the cops got annoyed with me, they also started putting the pressure on the jerks.

Steady pressure works best but it takes time. They may try to wait you out, from there it's just a game of chicken and you will win if you persist.

Of course they may threaten you with retaliation, or the infamous "You don't know who you're messing with." When that line comes out, know that you have them on the ropes. With the Federal government involved, any higher organization has already distanced itself from these insects and they are on their own.

Good Luck
