I am guilty of spreading the (apparently) false news on the phase out period for ten round mags. I had read it last night and again earlier today. I thought here on The High Road, but maybe it was elsewhere. I apologize for making this wicked law sound even worse.

Ugggghhh... getting that NYS "pistol permit" was a real pain in the butt... I hope that the five-year expiry means re-certifiying, not doing a full reapplication.
 
Prophet.....one more to add: No more face to face sales of long guns. All sales must go through a FFL. However, you can hand them down to your family. I'm not sure about scary rifles though.

I'm still confused about my 15-round GI M1 Carbine mags. The rifle is over 50 years old.
 
Semi-Automatic pistols over 50 ounces are now defined as "Assault Weapons" by the "one feature" test. So, all Desert Eagles are now illegal. Are there any other heavy pistols out there besides the DE?

No apology necessary! You weren't the only person to mention it. If you do a search all of the major news networks were projecting the idea early on. I'm just glad that I researched it first before trying to use it in an argument which I almost did.

That's also a big one, thanks. So, to keep it up to date for all the latecomers to the party who don't want to review the entire thread like I had to;

-No more FTF transfers

-If you had magazines larger than 10rds that were grandfathered in 1994, those are now illegal and you must sell them out of state.

-If you have a non-C&R pistol that accepts 10 round magazines, you may keep your 10 rd magazines (until more stringent laws are implemented) but may only keep 7 rounds in them. Nothing mentioned of rounds in the pipe so maximum of 8 rounds on hand given no reloads.

-You must register anything the state defines as an assault weapon to a state registry.

-All ammo purchased online must go to an FFL.

-All ammo sales require a background check.

-The amount of ammo you purchase will be scrutinized and questioned.

-Your doctor can essentially revoke your firearm permit with little opportunity for recourse.

I hate to tell you people in NY but, if I were in your shoes I'd either be in full molon labe mode or getting the hell out. Rural PA is close, we'll welcome you with open arms and the addition of your numbers will help us to keep Philly and the Pitts in check. Hit me up.

I've been discussing this with an acquaintance who was quick to congratulate Cuomo for "making the US a little bit safer". I wrote this to him in response.

... it appears Cuomos original legislative intentions of forcibly confiscating firearms from law-abiding firearm owners or requiring sale of firearms to the state under penalty of law or moving to another state didn't make it into the legislation.

Instead, the law is requiring that lawful firearm owners like myself submit to a registry every semi-automatic firearm bearing one "military" (obtuse) feature. Any standard capacity magazines that were grandfathered in 1994 for the rifle must now be taken out of state and sold. The legislation is poorly written, essentially leaving it up to the arresting officer, prosecutor, and judge to decide what is an “assault weapon” and what is not. As a result NY firearm owners will be in the dark as to what they can and cannot actually own until some poor unsuspecting NYer is finally prosecuted as a means to create case law, at which point the owners of certain firearms will be in immediate violation and will not even be able to legally transport their firearm through and out of the state to sell it. The legislation further restricts those who currently own defensive pistols with 10rd magazines to keeping only 7 rounds in them. If caught with more than 7 rounds in the magazine NYers will be charged with a misdemeanor offense. Furthermore, doctors will now be given the ability to have NYers firearms license revoked. Ever been to the doctor? If they ask “how are you” and you reply instinctively with “good”, they write that down. Your entire visit is well-cataloged. This will cause firearm owners in NY to suck it up and deal with their ailments instead of going to the doctor when in need of treatment, or at least be less than open and trusting when discussing their conditions with their doctor.

I'm shocked that the fact Cuomo suggested such blatantly unconstitutional proposals as confiscation doesn't make your libertarian senses tingle, let alone the passed legislation itself. Honestly, I don't see how most of this legislation is going to do anything other than further cripple law-abiding NY'ers ability to defend themselves and unjustly punish them for the actions of some wacko.

In hindsight should have mentioned to him that Cuomo was still in essence confiscating certain firearms by legislation. (Hey, our new rallying cry could be "No confiscation by regulation!" Heeh. Sorry, too much coffee today.)

He expressed his inability to argue with my points and said that he would like to pick my brain further on the topic at a later date, and admitted that it's likely I could convince him. I'm not holding my breath. The guy obviously doesn't understand the definition of libertarianism and has been badly brainwashed by public "educators" and the media.

NO DESERT EAGLES ARE NOT ILLEGAL. ..... because the mag is inserted through the pistol grip. try to keep up..... Our laws are so stupid. The weight restrictions were to stop the AR15 and AK pistols and Mac 10 type stuff. We sheep in NY and things like that needed to kept from us to keep us safe.

Also due to the change from 2 to 1 on the "evil stuff list", the following are illegal:

Glocks (due to Glock 18)
Beretta 92/Taurus 92 (due to full auto Taurus 93, same design but full auto)
Lugers (full auto models were made)
1911 (many were made full auto during Prohibition years)

and so on...

Sorry but a LOT of common pistols are technically illegal under this law.

All it takes is an aggressive arresting officer and state's attorney to start generating case-law to lock it all in.
 
How does this affect integral tubular mags in non-c&r guns. If I had an 8 shot revolver is it illegal?

In my industry, new laws get written over the course of years by a team of engineers and scientists that generally have decades of 'boots in the mud' or research experience. It seems like every time a state crafts a gun law they find a bunch of folks that know less about guns than I know about the female reproductive system, and let them crank some half bake laws out in a matter of hours.

No..... 7+1 = 8

If you're allowed a total of 8 in your 1911 then you're allowed to fill your 8-shot cylinder as well.

Well, if any good comes from this, its that Cuomo has no chance of any political future outside New York now.

I expect that there will be some seats changing in the republican senate in NY in the next election.
Why? Both the candidates who ran in the last election were proven gun grabbers.
And we elected the biggest one, Obama could not have been elected without a lot of gun owners voting for him.
