(3-6) 18:35 PST HEALDSBURG -- The fatal shooting of a home intruder in a ninja mask was tentatively found to be justifiable homicide, Healdsburg police said today.

"We don't have any evidence to show otherwise,'' said Sgt. Tony Pinochi, following an investigation into the Feb. 27 shooting of David Ferguson, 48, by Healdsburg resident Louis Phillips.

Ferguson, a former employee of Phillips at an Indian tribe's casino near San Diego, was dressed in black and wearing a ninja-type mask when he assaulted Phillips wife, Sandra, before entering the couple's home, police said. Louis Phillips, 68, shot Ferguson three times with a .357 Magnum revolver.

Ferguson was carrying a BB gun, tape, a blindfold and a knife when he was shot.

Ferguson was the chief financial officer at the Viejas casino east of San Diego in 2000 when Phillips, the chief executive officer, fired him, police said.

I'm glad her husband fought back

"they" allways tell us not to resist, I wonder what would have happened if the husband subscribed to this philosophy?

If you're not smart enough to bring a gun to a gun fight, you should reread the comic book.
