The mostly successful test run for that happened a few years ago.local governments will come up with "emergencies" to justify
This has become an ingrained attitude with politicians- those who govern no longer feel bound by our written constitutions and justify their tyrannical policies by claiming that rights are not absolute.
State and local governments have temporarily suspended or limited constitutionally guaranteed rights during declared emergencies before. Hurricane Katrina in 2005 is a prime example during which the 2A was suspended in some affected states. That resulted in several states, mine included, putting "Katrina" laws on the books specifically preventing state and local officials from suspending sales and carry of firearms during such emergencies.
To my knowledge, no governor has suspended constitutional rights in just a community without a declared state of emergency before.
Yeah but unfortunately for her by doing so she not only violated the US Constitution she violated the New Mexico Constitution. And said she'd let her personal ideology override her pledge of office again if she had to. That last one is unconscionable, none of us have the right to surplant our oaths with our ideologies. Her contention is that gun violence itself was grounds for declaring a state of emergency, and she declared it.
Sorry fella, but your take is extremely NY centric. It never ceases to confound me when commentary on blatant usurpation of Constitutionally articulated rights are viewed by the deep blue state denizens as 'understandable' due the perspective of the left. Sorry , but I refuse to accept that point of perspective and I hold that giving it credibility in any form is destructive to our core structure and belief system.........NY, Calif. and others of their ilk have done more than enough damage and ought not be excused in any fashion.........even inadvertently. She is correct about that. We've discussed this. The scope of rights is determined by the social circumstance and what the courts and legislatures will go along with - determined by the social circumstance and individual views of the Justices and legislatures. Been that way throughout our history.
Bruen and Heller weren't 9 to zip decisions. Free speech - from England, the home of our democracy - they just banned ads for artisanal cheese on the subways as it has too much fat and is thus bad for you. Posters of guy holding some wheels of cheese were taken down. If it saves one person - NO cheese for you.
Probably not. Term-limited already, and the EO will expire in like 22 days, probably about 40-50 days faster than an Impeachment could occur. So, will she be removed and prosecuted, and at all levels?
I love this idea! Can we start a campaign or something?i propose, just as certain christian denominations profess the nicene creed as an article of their faith, that officials are made to publicly read aloud, and positively affirm to, each of our bill of rights, upon being sworn into office.
Going after guns in New Mexico is a losing proposition. Same in Texas. Beto O'Rourke sealed his political fate when he blurted out "Hell yes, we're going to take your guns." He'll never be elected dogcatcher in Texas. When is the next House or Senate race in NM? That's what she is up to.
Then the Arizona Democrats must have a political death wish. Arizona is on the knife edge politically. Going on an overt antigun crusade will cost them the state next year, and with it the Presidency. Here's what AZ Dems think about this situation!
