Good day to all.

I have a co-worker who is a German citizen looking to eventually get his permanent residency here in the states within I believe two years. He asked me a question and had no good answer for him and was hoping I could get some feedback from you folks.

What is his capacity, as a foreign national living here legally, toward personal firearms ownership in the State of Texas? No firearms at all? Only long-guns? Only shotguns? Once he becomes a permanent resident I believe he is allowed the full protection of the 2nd....but until then what can he do?

Unless things have changed in the last couple-three years -

My wife was a "Permanent Resident" (Green Card holder) until recently and she owned, transferred, bought & sold quite legally.

In fact, she was a principal in a manufacturing concern of multi-title/multi-class firearms.

Still, be sure to confirm.

As long as he is in the US legally, he can purchase, receive and possess firearms of any type.

If he is here on a "nonimmigrant visa" (temporary worker, student, tourist, etc) then he would need to get a Texas Hunting License in order to buy a firearm.

When he fills out the 4473 he would answer "yes" to Question 11.L if he is here on a nonimmigrant visa.

On Que. 12 he would answer "Yes" and provide a copy of his Texas Hunting License to the dealer. The dealer will record this information on Que 20.c

Que 15 he will write his alien# or admission#.

The dealer will then run an FBI NICS check. it has been my experience that these transactions are delayed for a couple of days until Immigration responds to NICS.
