NRA Lawsuit against Washington State

Personally - I have to side with Washington on this one. Not to raise the alarms here, but I can think of 19 guys not all that long ago who came to this country legally, and at one point would have passed a simple background check. 19 guys who are PRECISELY the people we do NOT want to have guns on our soil.

I absolutely do not want to minimize the tragedy of 9-11, but the statement above is, by definition, prejudice. "Pre-judging" ALL legal aliens by the actions of 19 aliens who may or may not have been legal is not a reasonable comparison, especially when you use it to apply the addition or subtraction of rights. If we follow the logic above, then US Citizens should not have guns because more people were killed in any given year by US Citizens than anyone else (including 2001). From there, we can start slicing and dicing the right to carry a gun by race and sex "these people get them and those others over there don't". You can see where it leads...

I did some very quick research and the data I found don't seem to support the theory that legal aliens have more of a propensity for crime than native US Citizens.

"In fact, the incarceration rate of the US born (3.51 percent) was four times the rate of the foreign born (0.86 percent)."

the quote above is here http://www.migrationinformation.org/Feature/display.cfm?id=403

FBI reports "Law enforcement agencies submitted SHRs to the FBI for 14,831 murder victims who were slain in 2007". I would guess that at least the majority of these were committed by US Citizens.

I believe I emailed most too, their poor interns and office workers are probably getting tired of the deluge...!

Next we shall bug them on the issue of fixing the States silly suppressor laws..!

Bill Hinkle doesn't even answer my emails, anymore. Of course, that might be because we chat on the phone occassionally. (Personal acquaintence. :D )

We are making an impact, folks. Keep up the pressure. What has impressed some of the fence-sitters is that they are getting input from non-LPARs. Cards and letters from people who won't be affected by this change is impressive.

Emphasize that this is NOT to allow illegals to carry and doesn't change the status of visitors.

Keep your notes and calls on subject. Remember, these are politicians. One subject at a time is all they can handle. :D

Pops;

I'm pretty much on a first name basis with my .gov "peeps" too.

One is even a friend on my facebook account.. LOL

The suppressor bill is running in parallel, I'm not sure how far it will make it this year, they seem to have it covered on the NFA websites, and some of us here have tackled it too.

Well I got "it" in the mail today... pretty fancy looking too. My old license looks pretty ugly compared to it.

The "accountant" just logged that I'll be buying a .22 rifle next week, plus I worked so OT...!!!

Good stuff :)
Hoping my "accountant" will be ok with mine too.
So this time I purchase a rifle at Cabellas, I will not have to return it 5 weeks later, after finding out that I shouldnt have got one.
I didnt know that it was illegal either, but they compensated me very well.

HR1052 Update

From the General Government Appropriations

1052-S AMH APPG ADAM 021 By Representative Pedersen SHB 1052 - H COMM AMD By Committee on General Government Appropriations
On page 4, line 12, after "(b)" strike "An" and insert "If required under federal law, an" On page 4, line 24, after "(b)" strike "An" and insert "If required under federal law, an" EFFECT: Provides that a nonimmigrant alien must possess an approved U.S. Department of Justice ATF 6NIA form only if the nonimmigrant alien is importing firearms or ammunition into the U.S.

So it seems it's been read.

The fact is, Washington's restriction is what is called overbroad or not narrowly tailored in equal protection language.

Basically, even if WA has a legitimate interest in restricting firearms to foreign nationals from certain nations hostile to us, it makes no sense to restrict it for ALL foreigners. Are we really worried about German nationals, Canadian nationals, Japanese, hispanics, etc. being terrorists/criminals?

Hell I'm originally from the UK, and Naturalizing. Applies to me too even though post 9/11 Bush declared us #1 Buddies :)

I think the original wording (and maybe I'm being a little charitable here) of RCW 9.41.170 was confused, I think the intent was non-immigrant, but the wording was non-citizen. Which has remained on the books since.

Anyway HR1052 looks like it's got a really good chance of passing this session still, and there seems to be a lot of traction on it.

Yeah it was read, weird thing about the An to an If deal...

On another note: It seems quite a few people are being delayed on the West side, any of you that applied for the license seeing long delays?

I mean mine was quick, 8 day turn around.

Yeah, like me...

I think I'll ping the DOL and politely remind them that there is a maximum 30 day limit on issuance according to the RCW, so they can kick the KCSO about it.

According to Zandra it's between 5 and 7 days to print and return the license, so if they haven't got my return from KCSO by Thursday, they're running over the 30 day limit.

Just posted this in other Thread.

Ok now I'm pissed off. I just got back from the Sheriffs Office (second time, first time the guy had doctors appointment) 35 miles away, and they call me at home to say they did the finger printing WRONG !!!!!!! Back tomorrow.
They took ink prints, should they take digital ones?
Tim

Jeez, you're having a terrible time at it.

Doesn't matter, I've had both, both work.

Ink prints are usually done when the guy doing the prints either doesn't know how to use the digital machine or the digital machine is broken, or they have no digital machine, those things are wicked expensive.

Prints are prints, sometimes the older guys that do ink pints are real masters at getting prints.

I did it! I got my prints done, at last. They wanted me back to have them done digitally, should be quicker. They did say it should have cost me more than $74.25, but because "the state" screwed up they wont charge me.

FYI

Feb 19 Passed to Rules Committee for second reading.

HB 1052-S2 - DIGEST
(DIGEST OF PROPOSED 2ND SUBSTITUTE)
Repeals the current alien firearm license statute and establishes new requirements and procedures governing possession of firearms by noncitizens.
Prescribes penalties.

RE "noncitizens"
Summary of Substitute Bill:
The alien firearm statute is repealed and new requirements for the possession of firearms by non-citizens are established.

The prohibition on a non-citizen's possession of a firearm without an alien firearm license only applies to nonimmigrant aliens. A non-citizen who is not a nonimmigrant alien (e.g., a permanent resident alien) is no longer subject to a criminal penalty for possessing a firearm without having obtained an alien firearm license.

Fingers crossed here folks

Back to the Rules committee

I know my coworker is probably pretty close, the DOL has the application from our Sheriff.

Other than myself, no one else has said they have received their AFL.

So I'm not sure what is going on, I'll ask Adrian on Monday.

If any of you are having a long wait on your license I can contact the NRA lawyer.

Just tell me here in the forum, of course you'll have to PM your info to me so that the lawyer can contact you.
