The town I live in is asking me to sign a waiver form which gives the police permission to ask my job to furnish them with any and all documents they want in helping to determine if I am eligable to own a fiream.

I have read over the state statute many times and it is very precise in what it says a firearm application can entail. This document the PD wants me to sign is BOGUS. I just hope me not signing it won't affect my chances of getting the permit.

Its a shame I have to jump through all these hoops to be able to excercise my 2nd Ammendmant Rights.

Sadly, it probably will. This is a big problem with "discretionary" or "may issue" permit systems: the PD can make up whatever bogus rules it wants.

I doubt if it prevents the PD from having additional requirements.

I found it curious that 15 states honor NJ permits, but NJ does not honor those of any other state. :rolleyes: But that is another topic.
 
Politely refuse to sign it, and remind them of this text from 2C:58-3f:

There shall be no conditions or requirements added to the form or content of the application, or required by the licensing authority for the issuance of a permit or identification card, other than those that are specifically set forth in this chapter.
 
I think Downr@nge is referring to a permit to purchase a handgun, not a permit to carry. I'm no lawyer, but NJ gun laws do not give local municipalities the freedom to amend state law. Try http://www.anjrpc.org/ and see what they say.

I have a friend who works for the NJ State Police (non-uniformed) - and has been for a number of years. And it took him a year to get his permit. Best of luck to you. Stuff like this is why I turned down a job offer in the NJ/NY area.

You will find, Downr@ange, that many law enforcement agencies in New Jersey violate New Jersey statutes in what they require for handgun licenses.

Don't sign the form. You don't have to, as stated above.

If they deny you, appeal. You have nothing to gain by sitting down and continuing to be a victim of NJ's unconstitutional laws now that the Supreme Court has ruled otherwise.

I think you are confused about rights. They do have every right to ask you to sign the form. They can ask you anything and to do just about anything legal. They may or may not have legal authority to require you to comply, but they can certainly ask.

The thing is, i'm NOT employed! I'm soon to start college!

So you are all upset about a query that doesn't even apply to you? LOL.
 
I second that opinion...if you have no employer, why be upset? Just sign the waiver!!!!

Yes, that's right! Just completely ignore the fact that the local LEA has no respect nor concern for state statutes! Let them violate whatever they want to and just ignore it! It should not be up to the OP to stand up for what's right.... let someone else do it.... someone that it affects... :barf:
 
Just because the op is not currently employed does not preclude the possibility of his future employment (although our President is doing his best to take care of that). It is nobody's business, especially my employer's what I own or don't own. What is shared here is with a fair amount of anonymity and at my own choosing.

Sign nothing and get active politically.
 
SIGN NOTHING, and after you've stated :

"This does not apply to me" SAY NOTHING TO LEO without legal counsel present. You do NOT have to be accused of anything to have legal counsel present. It's $$$ well-spent. REPEAT, say nothing except it does not apply to you.
 
Downr@nge, it sounds to me as though you need to find a lawyer who specializes in RKBA issues. A New Jersey gun organization or the NRA would be a starting point for that information.
 
The problem I have with something like this is that some employers might read more than there is there into the fact law enforcement is inquiring about an employee's application to own a handgun.
 
Bottom line is that there's a strong chance the PD will deny the permit if you don't sign. There may be on very shaky legal ground if they do so, but that alone might not stop them. If they do deny you, your may simply have to pursue redress in court.
