I'm sure this is also listed in the Columbus Dispatch and Toledo Blade and all of the other semi-worthless rags in the Buckeye State. I'm just confident of it. It being in the Daily News, though, is heartening.

I used to live down the street from that place during sophmore year of college. I'm glad they caught the other scumbag. I hope a needle finds it way into the arms of these worthless thugs. Robert Bragg is a hero in my book.

Spare Change Shooter Had Concealed Carry Permit

CINCINNATI -- A woman accused of fatally shooting a panhandler who asked her for 25 cents had a permit to carry a concealed weapon, authorities said.

Geraldine Beasley, 62, also paid a fine for unlawfully transporting a firearm in 2003, but the charge was not serious enough to prevent her from getting the concealed weapon permit.

She applied for the permit through the Hamilton County sheriff's office one year later.

Beasley is charged with murder in the death of Donald Francis, 44, who police believe was homeless.

Police said Francis had been standing outside a gas station late Aug. 6 asking people for money.

Beasley had complained about Francis to someone else and when he approached her to ask for 25 cents, she pulled out a gun and shot him, police said. Francis died at the scene.

Court and police records do not refer to Beasley having a mental illness, which also could have disqualified her from obtaining a permit to carry a concealed weapon.

State law disqualifies anyone with a felony or misdemeanor conviction related to drugs or violence from obtaining a permit. Most gun-related violations also are enough to disqualify an applicant.

"There was nothing to disqualify her," sheriff's spokesman Steve Barnett said of Beasley.

Beasley's attorney, Massimino Ionna, said he's not sure if he'll ask a court for a mental competency evaluation of his client.

He has denied that homelessness was an issue in the deadly shooting.

Some homeless rights advocates have alleged the shooting was a hate crime.

Beasley remained in a county jail Saturday on a bond of $500,000, and she's due to appear in court Thursday, authorities said.

They called him a CHL holder and attribute their source to a newspaper (Dayton Daily News) that never reported him as a CHL holder. The newspaper identifies him as a national guardsman. He identified himself as a military policeman.

I didn't see anything that said he was a CHL holder in Ohio, only that he used his own gun that he retrieved from his house. He wasn't even carrying it. As best as I can tell, somebody mutated the notion of the gun being personally owned to Bragg being a CHL holder somehow.

As a military policeman, he would certainly be more than just your ordinary CHL holder, assuming he was a CHL holder.

Two murderers that might have gotten away are now behind bars. That's good in my book. I'm not entirely happy about all of this "hero was conceal permit holder" smoke blowing on some level. I think it's great that it's getting out there that permit holders aren't psychos or egotists, but at the same time, statements similar to that are like they're calling it a license to kill.

If it had been me, who is not a permit holder, I would like to think I'd have done the same thing to stop them. Would I be in jail because I'm not a permit holder? Does Ohio Open Carry law cover such a situation? I'm basing this on the lack of statement in the article that he concealed it.
If he didn't conceal it, with the exception that it might have been held beside his leg on approach to conceal it from the killers, then it's open carry and there's no reason to bring up the permit. At the worst, it'd be brandishing, which the cops may or may not excuse in this example.

I'm just thinking.... Anyone versed in Ohio OC law want to chime in?
 
I hate to bring bad light to this guys but this is only the beginning. I know this situation very closely and it is unfortunate but there may be charges.
 
Charges for what? He didn't shoot them,....wait uh oh, did the magazine in his gun carry more than 10 bullets? That is a stupid Dayton city ordanance, no high cap mags for you. What else could they charge him with,...inciting a panic or something? If he hadn't stopped those men, who'd to say they would have never been caught, he deserves a medal, or a steak dinner or something.

Dayton is a screwed up place run by liberal Democrat anti gunners...but I can't imagine any jury convicting him. I can't speak for the leadership but if Dayton brings charges against him I suspect our group BFA will probably consider starting a defense fund for him.

With passage of HB347 into law such silly ordinances banning high cap magazines or so called assault weapons bans died . Now state law reigns supreme.
