Open Carry, TX. style

    The open carry bill passed the Texas Senate last month and we have been waiting for it to be voted on in the House. Not sure how much different the House bill is from the Senate version but do know the anti pushed an amendment on it to wait until the 1st of Jan. 2016 to take effect. I do not believe the house bill has that written in.

    HB910 (Licensed Open Carry) is scheduled for a second reading and floor vote in the House on April 14. If it follows the usual course, the third reading should be about April 15th and then on to a conference committee if there are differences with the Senate version (SB17) or on to the Governor otherwise. HB910 was reported out of Public Safety with the same language as the Senate version.

    The January 1, 2016 thing wasn't an anti thing; but was necessary to sync up the training schedule so CHL instructors could add retention training to the class.

    Does that mean we will not be able to open carry until receiving the training even if our CHL is good until 2019 as mine is?

    Mr. Mike F., who knows until it actually happens. It seems like trying to get a permit for something that a given town has never heard of.:banghead: When it happens, I will welcome it with an attaboy for our legislators. Till then, gotta keep it concealed.

    No. It just means new licensees will learn retention skills during their CHL class - which is not a bad idea regardless if you carry a pistol.

    Yes, the House "stands at ease" at the moment. When they get back in action, HB910 is the next bill to be considered.

    Yes, apparently there was a known glitch with the witness testimony software. An anti-gun Rep raised a point of order that killed off HB910 and all remaining legislation for the day; but they waited for HB910 to come up before they raised it.

    TLC apparently already has a fix for the problem which will be implemented and tested by 5:00pm today. And TLC will send a report to the Committee Chair by morning April 20 explaining in detail what went wrong.

    I wonder if the Constitutional Carry will ever make it to Texas?

    It seems like several states may be reading the writing on the wall and realize it's going to pass SCOTUS eventually.

    Any word on Campus Carry. Our Daughter is a CHL and going to college post-baccalaureate at night.

    She got jumped, walking to her dorm from the library at night, as an under-graduate but she's a fighter and managed to "nad" the guy. Turned out several weeks later he got caught trying another girl but our Daughter's general description couldn't get him prosecuted in her case. He was not a student.

    If open-carry passes I'll probably complete mine. I have an issue that makes it difficult for me to wear a coat or jacket. (Crutches) I've gotten tangled up in my own coat. Anyway...with all of this House maneuvering when will we know something?

    Campus Carry has passed the Senate and been reported favorably out of the House Public Safety committee. It is in Calendars waiting for a floor date right now.

    They sent HB910 (Open Carry) back through the Public Safety Committee today to fix the errors in the Witness List. The Chairman said the bill will probably be on the floor Friday.

    Who was the "anti" who raised the point of order? We need to work on him!

    Is this political maneuvering going to go on until the end of the session and the bill is dead? I hope not!

    There is slow. Then there is Nebraska. But even more so, there
    is Texas. My USMC older brother lived in Corpus Christi for 25 years. 1985-2010.

    He always told me , " I'll die before we see Open Carry."

    He was right. He died on March 10,2010 at age 79, and is buried in Lubbock after full military honors. (1946-1952) Including 2 years of Korean "Conflict" combat.

    Rep. Trey Martinez Fischer (D - San Antonio). There were several bills affected and apparently the glitch was well known; but no objection was raised until HB910 came up. There is some speculation that Fischer was trying to use the point of order objection to bargain for an anti-gun amendment to further limit open carry but that is just speculation since they turned off the mics for about 20 minutes while that was discussed.

    HB910 is confirmed on the House Calendar for this Friday. Hopefully it gets a floor vote this time.

    It will not take effect until January 1, 2016 if signed.

    On April 14, Open Carry Texas posted a picture on FaceBook, supposedly of Representatives lining up to add amendments to HB910. Any word on proposed or actual amendments to the bill?

    I'm sure amendments will be offered from the floor. IIRC, it takes a simple majority vote to amend the bill on the second reading. On the plus side, the bill already has 80 sponsors as written - so they will have to swing at least 6 bill sponsors to amend it. I hope it will go much like the Senate vote did.

    HB40 just came up. This was another bill that got knocked out on Wednesday by the witness software glitch.
