Looked at a current ad in Shotgun News and upon calling the ammo dealer, the prices had gone up almost 10 %. He told me the ad stated prices subject to change.

Had a similar situation with a local gun dealer. He took my order (and payment) and upon delivery raised the prices, saying the prices had gone up. Cited the language in small print on the receipt, "prices subject to change". This was for two guns from 2 different manufacturers. :fire:

Just wondering if some dealers use this as a way of raising prices even if their dealer cost didn't change.
 
It happens. I had a local gunshop try to charge a higher price than marked on a box of .32 S&W. Said it was because the cost had gone up. He wound up selling it as marked though...
 
Speedo, he took your money, ordered, then upped the price? I wouldn't tolerate that. I hope you did not either.
 
The ammo dealer is in the right, prices on this stuff are very volatile now. What do you expect from him?

The gun dealer however is a sleaze bag and in the wrong, prices may well be subject to change until you both agree to the purchase and the price. I hope you got every cent of your money back.
 
People placing ads in SGN have to do so some time in advance so the caveat makes more sense, since you place your order at some random time in the future. In the case of your in-store purchase, I wouldn't accept that. It's pretty much the same as if he called you up today and told you bring some more money to him because his prices went up again.
 
The deal was he only accepts cash, and special orders are non-refundable. They demanded a large deposit in advance, and then he hits me with this when I go to pick up the guns.

He then cites the print on the receipt about prices being subject to manufacturers increase. I wasn't present when the order was placed, my son did it.

The increases were relatively small, but that's not the point. I don't think I would have placed the order had I seen the receipt first, I wouldn't buy anything open ended like that. The receipt also stated there was a $20 fee if you failed the background check.

I didn't think there was anything I could do at that point, he had my money and the guns. I wasn't getting the feeling I should from a store owner when I just spent close to $700 in their establishment. I don't know why, but many gun shop and motorcycle shop owners act like they're doing you a favor selling you something.

Needless to say, I will not be patronizing that store again.

At that point I wasn't going to buy ammo there under any circumstance. When I was leaving I asked directions to the closest Walmart. Although I hadn't mentioned ammo, they made a big point of telling me I wasn't going to get ammo there any cheaper. .22 and shotgun ammo? Yeah right!
 
It's been awhile since I've studied contract, but it sure seems that if you enter a contract to buy something and pay in full in advance, failing to deliver at that price constitutes a breach and the dealer is would be required to refund your money unless prior arrangments had been made.

IANAL, maybe someone who is can elaborate.
