I am stuck with a Marlin XL7 bolt action rifle that has the ejector stuck in the down position. I disassembled the bolt down to the the bolt head and the ejector is held in place by a small crosspin.. I am not able to remove the pin for some reason..(bent up 2 small diameter punches trying). The pin is peened over on one side and below the surface on the other side. Does the ejector have a 'depression' that the crosspin fits between? Can't find any schematic(s) ….

There should be a groved in the ejector as you say. It's possible someone removed the ejector and improperly reinstalled the pin, or a screw up from the factory if the rifles isn't pre owned. It's also possible something is stuck in there.

I'd suggest applying some penetra to both the ejector and the pin.
Tap lightly at the ejector to see if it will pop free. If it does then try removing the pin just to make sure there isn't any damage to the ejector. If you can't get the pin out at least the ejector should work.

If it won't pop free, then use a tapered punch with a fine enough tip to get the pin started. If possible tap the side below the surface towards the higher side that's peened over.

I do warranty for Marlin and have had this situation a few times. I end up drilling the ejector out with a carbide drill in a mill. The spring is probably also toast.

I got it out! I took one of my ruined punches and filed it down with a small file and that worked! Ejector popped out and yes, the spring was toast. Luckily, I had an assortment of spring stock, and now back to shooting the rifle! Works good too! Thanks!
