I have a CCW, former law enforcement, former military with a Secret clearance, and currently ITAR certified due to my work in corporate security. And I'm a nice guy...
No idea why the feds hate me...
Academy has to abide by the same ATF regulations as any other licensed dealer, as well as abiding by the laws of the state where that particular Academy store is located.
Academy may have business practices that are more strict than ATF regulations....such as not transferring a firearm to a buyer who received a "delay" after three business days. The Brady Law does not prohibit such a transfer, but does not require it either.
If your dealer (or Academy, Cabelas, etc) has more stringent restrictions and business policies than required under Federal or state law......then simply don't buy guns from them.
None of which is a part of the NICS system. It is solely a name and descriptive information search.
I have a CURRENT local police officer who gets delayed.
Wrong. Where do ya'll get this stuff?
NICS is never told how many firearms are being bought or transferred. They don't get any information other than the TYPE of firearm(hand gun/long gun/other)......in your case the dealer would have indicated "Other". You can buy a thousand firearms on that 4473 and NICS will only be told your name and descriptive information and the TYPE of firearm.
NICS is for background checks on the buyer and has nothing to do with the firearm registration.
And you never will. FBI NICS is prohibited from telling the dealer the reason for a delay or denial.
NICS will NEVER tell the dealer the reason for a delay or denial, due the Federal Privacy Act of 1974.
If you are calling back....you aren't talking to FBI NICS. FBI NICS has prohibited dealers from calling to check on status updates for several years.
They will refer you to NICS Customer Service where you will be told that you are not to call for NICS status updates, but to use NICS E check.
They are "so adamant" because Tennessee uses TICS, not FBI NICS, as the point of contact.
For the billionth time, FBI NICS doesn't care one whit about the serial# of the firearm because it isn't a gun registration program, but a buyer background check program.
I'm guessing that a search of your name turns up numerous responses due to your background , triggering further scrutiny thus a delay ...?
His background ( CCW, former law enforcement, former military with a Secret clearance, and currently ITAR certified) has absolutely ZERO, NOTHING, NADA, ZIPPTYDOODAH to do with an FBI NICS background check.
The NICS check is strictly a name and descriptive information search. It's not a check on CCW status, your former or current employment, military service or secret clearances. Those have nothing to do with anything. If your name is identical or even similar to that of a prohibited person, you can expect multiple records to be returned to NICS during the check. The call or online echeck will be forwarded to an FBI Legal Documents Examiner who will compare the records of the buyer vs those of the prohibited persons whose records also appeared. The examiner will then issue a proceed/delay/denied status. If "delayed", then the Brady Law does not prohibit the transfer after three business days, beginning the next business day. The NICS will use those three business days to conduct additional research on the buyer.
That people keep repeating the same incorrect information (muh Uber Top Secret Clearance, Seal Team 6, CHL/CCW/LTC/etc, former or current police officer. etc is what causes my delay) shows a complete and wholly ignorant understanding of how NICS works and what the NICS background check uses. Anyone that wants can read the same information I posted by merely going to the FBI NICS website and spending a few minutes. https://www.fbi.gov/services/cjis/nics
Being ignorant of what NICS is, does and how the process works means your posts will mislead members of the forum. That ain't right.
Mr Dogtown --- If you reread my post , punctuation included , you will see that I did not make my statement in the context of fact ; it was speculation.
I yield completely to your apparent expertise in the subject of this thread. You are the master of the subject. Sorry for adding a comment. Sorry for rocking your boat. You Win.
Call it speculation, guessing, opinion, a hunch, or conjecture...…..by any name it doesn't do the forum a service, but a disservice. The reasons for a delay are not a secret and the only reason to speculate is because you haven't bothered to Google.
It's not about expertise or subject mastery, but about having spent a few minutes reading at fbi.gov. Do that and you won't need to speculate.
If you don't like public response to your comment then why post on a public forum?
Yet, I have never been delayed on a gun purchas, and my guy still uses paper and the phone....
I can’t explain it,, maybe you can??????
While he may have the exact same name, his descriptive information may not be anything close to yours.
Place of birth, height, weight, sex, birthdate, ethnicity, race would need to be nearly identical to cause you a delay. This is also the reason that listing your Social Security Number is helpful.
I was delayed on the ones bought the last couple of years.
Separate names with a comma.
