Shipping ammunition to states like California.

I have some 5.45 x 39 ammo but no gun for it.

I'm going to list it on Gunbroker but don't know which states allow ammo to be delivered to the buyer's home, and which states require it to be delivered to an FFL.

Anybody else have that dilemma? How do you handle it?
 
Another potential issue...if you have actual mil spec Soviet ammo designated "7n6" in its markings the ATF ruled it was "AP handgun ammo" and it will therefore potentially run afoul of many state laws. Only one thing I can say for sure...check Illinois OFF your 'can ship to' list for this reason.

Hey...you COULD just add that caliber to your stable. It fills a certain niche.
 
Do what you like, but I've noticed many GB sellers flat out say no shipping to states like CA. It sucks for the gun owners there, but I can't really blame the seller. It's a risky proposition getting caught up in the legal jungle that is CA anti-2A laws. As stated above, if shipping ammo to CA it must be shipped to a FFL. They have to have a background check to buy ammo there. I don't know about other states.
 
I used to look at that list and think that the only thing that was legal to ship to CA was the empty box! It sure is sad to see that we have gone from a drug store or supermarket was able to sell firearms and ammo with no hassel to the current state of things in respect to being legal in 2/3 my lifetime. Shure didnt see this coming when I was a teenager thats for sure.
 
The UCC, Uniform Commercial Code, specifies that if the contract (terms of sale) specifies that the buyer takes title FOB shipping point, it's the same as if the buyer bought the ammo at your door. California law stops at the California border, not at your house. They could moan and roar and s*** on the floor but there is nothing they could do to you. Their dealings with the buyer is the buyer's concern, not yours. They rely of fear, bluster and intimidation. I'm not a lawyer and this is in no way legal advice, but I do have considerable experience in this area. Do as you think best.
 
In NY, it depends on the company for commercial sales. Some won't ship to a residential address.
 
An exception to the CA ammo rule is if the buyer has what is known as a C.O.E. This is a certificate of eligibility. The holder must endure an FBI background check and have finger prints on file with CA DOJ. Many 03FFL holders have this for the exemption to the 10 day hold on C&R firearms. It also allows ammo shipment directly to your door.

There are many distributors that will ship, but probably more that won't.
 
After looking at the link from Sportsman’s my question is what can be shipped to CA?

Some things, as long as every single item being imported into Kali says "this item contains materials which are known by the state of CA to cause cancer..." blah blah blah. I've seen guys post online that Amazon won't ship completely benign things there simply because they don't have that prop 65 label.
