Stolen gun insurance claim?

Help me out on this one. My gun was stolen then recovered by police. I told them the cops have my gun and I asked about getting it back bottom line 6 to 8 months. According to LEO the judge can order it destroyed(slim chance) or returned to owner. I have no idea on its condition and aparently cant find out either. Insurance will cover the loss but since it was recovered I called them up with 2 what if's I asked are
1. if the gun is good and undamaged do I have to pay you back when and if I get it back?

2. what if it id damaged and worthless?

for both answers the insurance person said. If the gun is damaged it is my responcibility to get rid of it. or if it is good I can get rid of it or keep it.

Does that sound right to you?

I would like to hear from others that have made claims and later recovered the guns.
 
Generally, from what I understand, the gun goes to the insurance company if they've paid you for it. You can then have them destroy it, or, if it's in good condition, you can pay the sum they paid you back to them and have the gun given to you. :)
 
In general, your insurance will cover your actual losses. If you get your property back in the same condition it was, you really don't have a loss. Generally when you get a claim settlement, you sign something stating that if you do recover something later on, you either have to reimburse them or turn the property over to them.
 
I like my guy, he drove me over to the kool aid stand and said pick identical ones or order them. Evidently they had an agreement in advance since I had such good documentation. When one of the four was found, he let me have first dibs on buying it for what he paid for the replacement. I gotta tell you it was way lower than what I paid new!
