Suppressor - Transporting legally

Ok... I know one has to fill out the form and send to the ATF for approval to transport your NFA item out of state.

I also know that whatever NFA item your transporting needs to be legal in the location your going to transport it too. As well as it’s probably wise that the states you travel through to your destination should probably be legal for the NFA item as well.

Now knowing all that... as we all know each state is also different in transporting firearms in your vehicle. If you have a LTC/CHL and if that state as reciprocity with the one or multiple LTC/CHL’s you have. (I currently have 3 soon to have 6). Texas with LTC you can transport loaded and concealed on your person for example. It’s also legal to do that if I am in NM, and Utah.

Now the question is with suppressors. It maybe classified as a firearm, but it’s also not something that can either be loaded or unloaded. You can have it on your firearm or not. But what are the rules for transporting? Can I have it laying on the dash, console, or in my pocket? Or in the glove compartment? Under the seat? In the door pocket?

I checked with various states where suppressors are legal, but could not find any rules or regulations on carrying or transporting them. Some has restrictions on usage. But could not find anything else.

Any insight would be helpful. I do try to remain legal, I don’t wish to give anti-gunners any “ammo” against us! Lol
 
The 5320.20 form specifically excludes silencers. Otherwise, yes, whatever NFA items you are transporting must be legal in the state you are traveling through/to (assuming stops are made). The screen grab below is all I have time for right now, but it is straight from the ATF.

I have filled the form out numerous times, and received approval for my SBR’s, never noticed anything about Silencers.

So are you saying the form isn’t needed for the silencers? However... my main question though is still on transport method.

open, concealed, locked etc... obviously when we aren’t near it, it should be locked up to prevent theft. That goes without saying, or at least I hope it would.
 
Not needed for silencers per the ATF themselves. "Carry" the silencer on your seat or taped to your head if you like. It doesn't matter since it's not a firearm.

Thanks that is what I was thinking, but I am smart enough to know what I think sometimes doesn’t matter since it’s not always correct!
 
I've already covered this, but the best way to confirm it would be to contact your local ATF office. When I got into NFA I had several questions which my local office took the time to answer.
 
So are you saying how we carry and transport maybe regulated?
Well, I thought by putting his words in bold it would be clear. The bolded part of his post "Havok7416 said: ....... It doesn't matter since it's not a firearm."
Federal law/ATF regulations disagree....a silencer IS a firearm.
