1. The NICS check is FEDERAL LAW and therefore applies in EVERY state (all 50, plus DC, Puerto Rico, and the territories). Background checks are required everywhere under the Brady Bill.
2. The Virginia Tech MURDERER, Seung-Hui Cho, passed a NICS check for each of the two guns he acquired through an FFL dealer. The best background check system available failed in this instance but the shortcomings of NICS regarding mental health records have been addressed by the Congress.
