The AR-15 design is not Colt's intellectual property because they used someone else's design. The HK design of the MP-5 is their own design, and can file litigation because it violates their IP rights. This is the reason for the lawsuit.

HK can make a solid case because the GSG design violates the IP rights HK holds. Colt couldn't do that since all Colt has done is taken the design and manufactured it.

Colt could sue if their manufacturing process of the AR-15/M-16 was violated, but since they don't manufacture all of the parts and the design of the AR platform can use parts from any manufacturer, it wouldn't hold much water.

They are within there rights to sue ATI, but still........

I cant see GSG-5s becoming collectors at all, its a cheap MP5 knock off. A knock off that works for sure. Taurus for example knocked off S&W and they are good enough guns but collector value is next to nill. Only Colt ARs have any kind of collectors value (well the original AR-10s to). Knock offs just don't have to much collector value. Anyways im curious to see what H&K come out with to replace it.

taurus is not a knock off of S&W.Buna Punta owned both companies and moved S&W machinery to brazil.
all you guys bitch about china goods yet your not buying american.why you need "COOL" looking guns I will never figure.I want one that is inexpensive and works and I can get parts for.
and by the way colt lost their M$ contract with the gov.I wonder if they will survive.
 
I have a GSG-5...seen some more at Ft. Wayne, IN gun show today..they were grey an black, different front forearm, a bigger an shorter dummy suppressor.....hmmmm...is this to get around the trademark agreements...?.....also my son said he saw the HK mp5 type .22LR an said it was overpriced an looked sick...think he saw a picture of it, not at the gun show.

Thats a sight and sound i could do with out, and I disagree, I think its ashame. They were something new, something interesting. Even if it wasn't your cup of tea. I think HK missed out.
In addition, and sorta a side note, I remember seeing meny other HK look alikes made by companies that were selling for alot more than the GSG's in .308 and 5.56 that HK didn't go after.
For some reason I first thought of metallica lol i know totally different situation.
 
What I don't understand is how they can successfully sue this company, but are evidently not interested (or were not successful) in stopping JLD from building the PTR91, which really is an HK copy, and not just cosmetically.
 
I stopped by my local gun shop today and put money down on a GSG-5P and PK, the rifle I already have:D

The gun shop manager said that his ATI rep called him this morning to update him on the news regarding the discontinuation of the GSG-5. I asked the manager if the rep said anything about what will happen next and according to the rep GSG has plans to redesign the GSG-5 so that it's no longer an MP-5 clone. Not sure how true this is but that's what the manager at the gun shop told me. Makes me wonder what it will look like if it can no longer look like an MP-5:uhoh:

I think this answers the question regarding the PTR-91 and any G3/Cetme clones out there......
It is clear to any gun enthusiast that the H&K MP-5 is based on the design of the original G3, a design which is owned by the German government. It is also well known that the German government and several other nations gained permission to create the G3 and other variations based off of the original Spanish CETME assault rifle. These firearms are still available for sale in many countries around the world. This information is noted in detail in H&K’s history book, “H&K Heckler & Koch” by Manfred Kersten and Walter Schmid, available through firearm and book retailers. German Sport Guns and ATI feel that this information available in the public domain greatly helps solidify our stance regarding the GSG-5.

HK has contracted another company to create a .22lr versions of the mp5, mp7, g3, and hk416. You HK haters crack me up everytime. Makes me proud to have my HKs. A bunch of jealous little kids...

The "you suck and we hate you" started a long time before the battle between HK and GSG started.

People can choose to dislike HK the same way others can choose to like them. Calling people jealous little kids because they choose to not like HK is in itself pretty childish.

Just got up an saw post #42...HAA!!! Cracked me up.....if HK is so great how come they
have to contract others to build something they should of but couldn't.....like the GSG-5....?
 
Bravo to HK protecting their IP! Some of y'all are just upset because ATI made a .22 that looked like the cool MP5 and y'all wanted to look cool too and now you are complaining because that is being taken away.

ATI could make their own exterior design gun and sell it, but they wanted to piggyback the cool factor of the MP5.
 
I have both the GSG-5 and the HK91 and I wouldnt trade either one.

Umarex is the company making the .22 Colt AR-15's isnt it? The clones that wont run?

If ATI had went to HK then they might have got the contract.

Maybe Cetme needs to get into the lawsuits too since they invented the rifle and sold the rights to HK. I had a Cetme and it was a fun rifle after I spent months researching it to get all the bugs worked out so I bought a HK and it ran like a champ right out of the box.

I dont know why people hate HK, I have found the ones I have owned to be fine rifles. If you dont like HK thats fine, just dont flame someone elses choice of weapon.I went shooting with my brother and he brought out a .45 in a brand I would never own and bragged how it was a third the price of my 1911 and we started shooting, about the third or fourth shot his slide went off the front of the frame and hit the ground. I never said a word because it was HIS choice to buy the pistol. Never do I talk about other peoples choices in guns , wives or politics because I dont want their opinions on mine...

Who the hell cares if a .22 runs like a top? It's a 22, you shouldn't be using it in a life or death situation anyways.

I have 2 hk pistols that have never malfunctioned and I wouldn't trade them for any other pistol on the market.

What if you were being attacked by a grizzly bear? Would you stick to your H&Ks or trade for some of the big booming wheelguns? My brand loyalty only goes so far.

I don't think that people are buying GSG's because they intend to use them for self defense. People buy them because they are cheap to shoot and fun.
