Guys, the FOIA request is starting to cause them some grief already. An email copy was sent to Senator Jennie Forehand and her staff replied that it was Senator Garagiola's bill. They didn't know that Lenett was the author. The AGC member reminded the staff that since Senator Forehand had lent her name as a co-sponsor she was still responsible for answering the FOIA request. None of us should pass up the opportunity to make them squirm. :evil:

Dear Senator ___________

Due to legislation sponsored by you, I hereby formally request the following information under the Maryland Public Information Act:

1. Number of assault weapons (assault pistol, assault rifle, or assault shotgun) actually used in the commission of a crime or crimes during the period from 2004 through 2006. This data should be identified by the year, the state in which the crime or crimes were committed, the type of crime or crimes, and by the type of weapon or weapons involved.

2. Number of private citizens assaulted by criminals using assault weapons (assault pistol, assault rifle, or assault shotgun) during the period from 2004 through 2006. This data should be identified by the year, the state in which the crime or crimes were committed, the type of crime or crimes, and by the type of weapon or weapons involved.

3. Number of private citizens killed by criminals using assault weapons (assault pistol, assault rifle, or assault shotgun) during the period from 2004 through 2006. This data should be identified by year and by type of weapon(s) involved.

4. Number of law enforcement officers assaulted by criminals using assault weapons (assault pistol, assault rifle, or assault shotgun) during the period from 2004 through 2006. This data should be identified by the year, the state in which the crime or crimes were committed, the type of crime or crimes, and by the type of weapon or weapons involved.

5. Number of law enforcement officers killed by criminals using assault weapons (assault pistol, assault rifle, or assault shotgun) during the period from 2004 through 2006. This data should be identified by year and by type of weapon(s) involved.

6. Copies of all original and or raw data in your possession from government and law enforcement agencies, including but not limited to the Maryland State Police, state and local police agencies, Federal Bureau of Investigation, Bureau of Alcohol, Tobacco and Firearms, Department of Justice which support the need and or justification for Senate Bill 43.

7. Copies of all raw data and or publications in your possession from special interest and or lobbying groups, including but not limited to CeaseFire Maryland, Brady Campaign, Johns Hopkins Center for Gun Policy, Handgun Control, Center to Prevent Handgun Violence, and Violence Policy Center, which claim to support the need and or justification for Senate Bill 43.

8. A complete list of all crimes involving the use of a semi-automatic handgun or handguns equipped with a threaded barrel at the time of the crime during the period from 2004 through 2006. This data should be identified by the year, the state in which the crime or crimes were committed, the type of crime or crimes, and by the type of weapon or weapons involved.

9. A complete list of all crimes involving the use of a semi-automatic handgun or handguns which could have been equipped with or accepted a threaded barrel at the time of the crime during the period from 2004 through 2006. This data should be identified by the year, the state in which the crime or crimes were committed, the type of crime or crimes, and by the type of weapon or weapons involved.

10. A complete list of all semi-automatic handguns which will not accept a threaded barrel and will thus not be banned by Senate Bill 43.

It should be noted that by law, you have 30 days in which to respond to this request.

I suggest just co-sponsors. They should be forced to justify their position in sponsoring such garbage.


Don't forget to write the letters to YOUR reps though, letting them know you expect them to oppose it.
 
I don't actually live in Maryland, but I live less than 3 minutes from the Maryland border, I work in Maryland, and I otherwise spend the vast majority of my time awake in Maryland.

Would it be time well spent for me to write to some of these Senators, or would anything I say be ignored purely on the grounds that I am not a Maryland resident?
 
They'll ignore it, but every piece of paper on their desk helps......
 
Thanks for the info and the foia template, my senator so far hasn't co sponsored, so far I have e-mailed him "congradulating" him for not sponsoring and urging him to kill this bill. Spread the word to as many as you can. If this bill passes it will only reinforce O'malley's stance for gun control and who knows what bill will be next?
 
Is Haines your Senator in Westminster? If so, you can just thank him for his 2A support and opposition to the AWB in the past.

I've written a few Public Information Act requests in Maryland. They're legally required to respond, they cant just ignore them.

Sorry....I misread the post. Thought he meant just a general letter, not necessarily a PIA request.
 
I think Notron was implying that they would somewhat ignore basic opposition letters from out of state, not the FOI/PIA requests.

I say the more paperwork and opposition they see, the stronger they'll feel our impact. Make them waste their time like we have to waste our time...our vacation time, or time from work to go and fight this garbage every year.

On a related note, dont forget to change your questions from the above list. If they're all the same, they can respond with a form letter.
Ask for 2004 only, or 2005 only, or 2005-2006, etc. If you really want to be a pain, demand data from 14 September 2004 to 13 September 2005, etc.
Make those interns work for their stipends. :evil:

Yes, good call.

I should give credit to Associated Gun Clubs for starting the ball rolling on the PIA's, and credit for the earlier sample I posted.
 
I know that for standard letters, snail mail is better than email, but does a snail mail FOIA carry any more weight than one sent through email?

Also, does "they have to respond" mean that they can reply without actually answering the question? ie: "It's good to see so much interest in the law making process, my staffers are working on it. . ."

edit: btw, any word on what Tripwire is doing to help fight this bill, or is he satisfied with "they don't pass gun laws in the first year after an election.":rolleyes:

If a letter is sent 'certified mail' then they cant claim it was lost in the mail, as the post office keeps a record of its delivery. And IIRC, it also counts as being legally filed on the date of the postmark if you send it certified.

Great point Kharn. That's what I was going to do with mine, but hadn't thought of something as simple as changing the dates. We should remember to keep the start date after Nov. 2002.
 
Spot77, Yes he is, and Roscoe Bartlett is our representative to the H.O.R., both have stood up for us on 2A issues in the past and they both tend to reply personally to e-mails I have sent in the past, Carroll county tends to be more gun friendly than most of the rest of the state, unfortunately the poulation is only a small fraction of those in the baltimore/dc area who tend to vote anti. But the more vocal we are the better. Also you can petition the NRA for assistance https://secure.nraila.org/Contact.aspx
 
I think at the very least, sending a letter to a pro-gun rep in a pro-gun district just reinforces that they won't face retribution from antis for taking a stand against laws like this.
 
any word on what Tripwire is doing to help fight this bil

I'm not worrying what he does one way or the other. We're moving forward with or without.
