Shelby County men who shot and killed robbers won't be prosecuted

The Shelby County prosecutor's office has decided not to
prosecute two residents who shot and killed robbers.
District Attorney General Bill Gibbons said yesterday his office
won't prosecute Jason Filippelli.
The 22-year-old Filippelli was using an A-T-M Friday night when
two men jumped him. Authorities say 21-year-old Ricky
Ricardo Wilborn and 24-year-old Ali Ford took the money Filippelli had
withdrawn and demanded more, forcing the victim to drive them to his
home.
Investigators say Wilborn went inside with Filippelli, who
was able to draw a pistol and shoot him dead.
Police say Ford then confronted Wilborn and was also shot.

Ford faces robbery and kidnapping charges. Gibbons'
office said last week a 71-year-old homeowner was justified in fatally
shooting an intruder.
Gibbons cautioned that his office reviews each case on its
merits and the use of deadly force solely to protect property may not
shield people from prosecution.

Frankly, I think it's wrong to consider criminals' lives of greater value than the property of their intended victims. Yes, I'm a big believer in the sanctity of human life, but predators who ask no quarter and give none should be treated accordingly.
 
SOmeone NOT being charged for defending themselves shouldnt even be news. It should be a safe assumption.
 
I think the prosecutor needs to re-read the statutes on self defense. In TN a home owner who is the victim of a home invasion has the right to assume that the perp has the intention to do harm and is therefore subject to deadly force.
That is what I was taught by the TBI ( TN Bureau of Investigation ) and have read the law many times.
