Just spotted on Breitbart an article indicating Dems in Washington state are introducing really draconian legislation, which if enacted will outlaw most firearms in common use, with the notable exception AFAICS of revolvers.
Here is the url: http://www.breitbart.com/big-govern...ts-seek-bans-on-semiautomatic-rifles-pistols/

They seem to be hell bent on the total destruction of their party. Not a clue as to just how many people cherish their second amendment rights

Yet another lie from Breitbart, one of the more disreputable fake news outlets, devoid of credibility and merit.

Semiautomatic rifles and pistols will still be available to state residents.

Indeed, the measure is no different than other similar state measures which have been upheld by the courts as Constitutional.

Wrong.

The proposed measure is perfectly Constitutional; it in no way ‘violates’ the Second Amendment, as the Supreme Court has never ruled on the Constitutionality measures which seek to regulate ‘assault’ weapons and high capacity magazines.

Last February the U.S. Court of Appeals for the 4th Circuit invalidated Maryland’s Firearm Safety Act, returning the case to the District Court for further review, subject to strict scrutiny.

Should this case make it to the Supreme Court, and should the Hight Court rule that the Maryland law violates the Second Amendment, then and only then will similar measures be rendered un-Constitutional.

The true threat to the rights enshrined in the Second Amendment comes not from those who seek to regulate firearms, but from Second Amendment ‘advocates’ who are ignorant of – or have contempt for – the rule of law.

The Bill will stop sale and transfer of the weapons to the residentS of WA.

Which cases are you referring to?

If SCOTUS hasn't ruled,,, How do you know it doesn't violate the 2nd A?

How I've seen this work in WA is there will be a legislative effort to ban/restrict something firearm related. It'll get nowhere in the legislature. Bloomberg and Co. will sponsor an initiative to the people in the next election cycle, it will pass by a wide margin.

Sigh.

Yeah, I found that remark curiously circuitous. It strikes me as a layman, that all cases brought before the Court are founded on the notion that there's something goofy about the law in the first place either in interpretation, intent, or application. Insert them legal words prima facie in here somewhere if you like.

Yeah, I know, all laws are presumed to be constitutional before the courts say nay, and maybe that's what jdc1244 meant, without putting words in his keyboard.
